The unified Korea is a national historic task. The way how two Koreas is unified will determine the future forms of government. On the condition that Korea will be peacefully and rationally unified, the paper aims at shaping the future unified Korea's power structure and governing principles. Despite being many a possible forms of government, the paper focuses only on a dual executive branch of government, sharing the executive powers between the popularly -elected president and prime minister. The basic principles of the unified Korea will be national sovereignty, separation of power, role of law, and parliamentary representation. Briefly, the unified Korea's power structure is presumed that the president and senate pray a part as a political coordinator, while constitutional court does as a political judiciary organ, and that power separation and rule of law are properly functioning among three branches of government. Accordingly, the study seeks to explore a multi-dimensional and systematic form of government, covering the dual systems of both the legislative and judicial branches as well as the dual executive branch in the semi-presidentialism.

한반도 통일은 민족의 숙원사업이다. 어떤 통일과정을 통해서 남과 북이 통합하느냐에 따라 권력구조가 달라질 수 있겠지만 남북이 평화적 방법에 의해 합리적, 이성적으로 통합한다는 전제하에서 통일한국의 구성 원리와 통치 구조를 구상해 봄에 본 연구의 목 적이 있다. 그 때를 가상하여 여러 가지 정부형태를 구상해 볼 수 있겠으나 본 논문에 서는 절대적 선택이 아닌, 선택 가능한 연구 중의 하나로서 이원정부제를 중심으로 하 여 논의를 전개하였다. 통일헌법의 기본 원칙은 국민주권과 권력분립, 법치주의와 대의 제원리에 근거하여야 할 것이다. 통일국가의 통치구조를 일별하면, 정치적 중재기관으 로서의 대통령과 상원, 정치적 사법기관으로서의 헌법재판소를 상위의 축으로 하여, 입법과 행정 및 사법이 적절히 그 기능을 수행하는 권력분립과 법치주의의 원칙을 기 본 축으로 상정했다. 즉, 통일 이후 일상적인 입법․행정․사법 활동에 대하여 그 갈 등의 요소들을 적절히 제어하고 수용할 수 있는 조정․중재의 기능을 대통령과 상원 및 헌법재판소에 함께 부여하고 있다. 따라서 단순히 기존의 이원정부제의 논의에 있 어서의 행정권의 이원화뿐만 아니라 입법권과 사법권의 이원화까지도 염두에 두고 있 는 입체적․공간적 정부형태의 구성을 모색했다.
