The right to housing refers to “everyone’s right to enjoy an appropriate housing,” “right to enjoy housing conditions befitting human dignity,” and “meeting a minimum standard in human residence.” Recognizing the right to housing means acknowledging that everyone has a right to live a life in a decent housing. By doing so, the state confirms that it is responsible for guaranteeing such right. Claiming for the right to housing through citizen movements or various social campaigns can serve as a realistic basis to secure it. In order for the same to be declared as a right, its contents to be finalized, and it to be requested to the government not as a matter of dispensation but as a matter of oughtness (the state of being as a thing ought to be), argument over the right to housing should be mature and such should be expressed in legislation. However, the right to housing under Korean law is an unfamiliar concept even nowadays. To a certain extent, it is understood that there exists a need for a measure of dispensation from the state in the form of government’s housing benefits though housing policies or cost-of-living allowances of many of kinds. However, social consensus doesn’t seem to be reached when it comes to claiming the right as the fundamental right. Since the right to freedom of even the socioeconomically strong can be infringed upon anytime, it’s not difficult for anyone to perceive the right to freedom as the fundamental right. However, such perception is not applied to the right to housing of the socially weak which is easily encroached upon and tends not to be recognized as a fundamental human right. This is maybe because there is still a strong tendency where the issue of residence is not seen at the national or social level but seen at the personal or individual level only. It may be realistic and natural to see a legislation to guarantee the right approached from the perspective of welfare. However, it should not be overlooked that the right to housing going beyond a mere welfare issue should be a prerequisite for guaranteeing human dignity. It is not about guaranteeing housing welfare but about guaranteeing the right to housing itself. Each and every human being should have their right to live in a decent living environment guaranteed, and this should be stated and guaranteed in legislation. There should be a legal environment created where a living worthy of human dignity is recognized as the fundamental right that goes well beyond receiving benefits of dispensation to secure a minimum standard of living.

주거권은 “모든 사람이 적절한 주거를 향유할 권리” 또는 “인간의 존엄성에 적합한 주택조건을 향유할 권리”, “주거에 관한 국민생활최저선의 확보”를 의미한다. 주거권을 인정한다는 것은, 모든 사람이 적절한 주거에서 생활할 수 있는 권리가 있음을 인정하 는 것이고, 이 권리의 인정에 따라 국가는 이를 보장할 책임이 있음을 확인하는 것이기도 하다. 시민운동 내지는 각종 사회운동 차원에서 주거권을 주장하는 것은 주거권 확보를 위 한 현실적 토대로 기능할 수 있다. 그러나 궁극적으로 이를 ‘권리’로 선언하고, 그 내용 을 확정하고, 시혜적 조치가 아닌 당위적 권리로서 국가에 요구할 수 있으려면, 법리적 논쟁이 성숙해야 하고, 법을 통해 명시할 수 있어야 한다. 그러나 아직까지도 우리 법에서 ‘주거권’은 생소한 개념이다. 주거권을, 주택 정책을 통한 급부청구, 각종 생계지원 급여 청구의 한 종류로 인식하여 국가의 시혜적 조치가 필요함에 대해서는 어느 정도 공감하고 있지만, 이것을 당위적인 “권리”로서 주장하는 부분에 대해서는 공감대형성이 이루어지지 못하고 있는 것 같다. 사회경제적 강자, 경제 적으로 유력한 사람에게도 ‘자유권’은 언제든지 침해받을 수 있는 권리이다. 그렇기 때 문에 자유권은 당위적 권리로 공감하는 것에 큰 어려움을 느끼지 않는다. 그러나 사회 경제적 약자들이 침해받는 생존권, 특별히 주거권 문제에 있어서는 이것을 당위적 권리 로 인식하는 것에 무언가 인색한 감이 있다. 주거의 문제를 ‘국가적·사회적 차원’의 문제 로 보기보다는 ‘개인적 책임의 차원’으로 인식하는 경향이 아직까지도 강하게 지배하고 있는 것으로 생각된다. 주거권 보장을 위한 법제가 ‘복지’적 측면에서 접근되는 것이 현실적이고 당연하게 여 겨질 수도 있다. 그러나 주거권은 ‘복지’를 넘어선 인간존엄성 보장을 위한 전제적 요건 이 되어야 함을 간과해서는 안 된다. ‘주거복지’를 보장하는 것이 아니라, ‘주거권’ 자체에 대한 보장이 먼저 이루어져야야 한다. 모든 인간이 적절한 주거환경에서 살아갈 권리를 인정받고, 이것이 법적으로 선언되고 보장될 수 있어야 하는 것이다. 최저생활 보장을 위 해 시혜적인 급부를 하는 것에 만족하는 것이 아니라, 인간다운 생활을 당위적 권리로 인 정받을 수 있는 법적 분위기가 조성될 수 있어야 한다.
