The conception of protecting the reliance interest has been established and becoming more and more mature in the field of the contract law.Owing to the special mechanism of the insurance system,the reliance interest in the insurance law is particular.Accordingly,the protection for the reliance interest is different.However,on the other hand,we still need to notice that the conception of protecting the reliance interest is reflected in many insurance law systems,but its pattern is rather fragmentary.Therefore,this paper will mainly discuss the reliance interest and its particularity in the field of the insurance law,then related systems is further integrated.

신뢰이익보호의 이념은 이미 계약법상에서 확립되어 발전하여 온 갈수록 성숙되어가는 이론이다.하지만 보험제도는 특수한 메커니즘을 가지고 있기에 보험계약상의 신뢰이익은 그 자체의 특성을 가지고 있다.따라서 신회이익보호의 문제는 보험계약에 있어서 일반 계약법상의 신뢰이익의 보호와는 다소 차이가 있다고 할 수 있다.한편 보험계약법상의 많은 제도들이 신뢰이익보호의 이념을 체현하고 있지만 그 표현상태는 많이 분산되어 나타난다.이에 따라 본문은 신뢰이익 및 그의 보험계약에 있어서의 특수성에 대하여 검토하고 아울러 보험계약법중의 관련 제도들에 대하여 새로운 정리를 하려고 한다.
