This paper aimed at investigating the attributes and problems of intangible folk culture assets of Japan in terms of the legal basis. The domain “intangible folk　cultural assets” is set apart from the “intangible cultural assets” in the cultural-assets system of Japan. “Something in which life culture is expressed well”, and “something in which the artistic process of change has appeared well” are given as evaluation standards for the designation. As a matter of fact, these standards are reflecting the “folklore” and “the changes process of folk customs”, which the academic circles of Japanese folklore have traditionally regarded as subjects of research. Although the basics of Japanese culture are of foreign cultural origin, the academic circles of Japanese folklore have constantly disregarded the cultural genealogical relationship of Japan with the rest of East Asia. They also have studied folk customs only in the restricted category of “Japan.” Similarly, relevance with the East Asia folk customs is underestimated in the evaluation standards of the designation of intangible folk cultural assets. The policy for folk cultural assets of Japan should be promoted from a Pan-Asian point of view.

본 논문은 법적 근거를 실마리로 일본의 무형민속문화재의 속성과 문제점을 살펴보는 것을 목적으로 하였다. 일본의 문화재 체계에는 ‘무형문화재’와 별개로 ‘무형민속문화재’라는 영역이 설정되어 있다. 그 지정 기준으로 ‘생활문화가 잘 나타나 있는 것’과 ‘예능으로서 변천과정이 잘 나타나 있는 것’이 제시되고 있다. 사실, 이 기준은 ‘일본민속학’이 전통적으로 연구대상으로 삼아 왔던 ‘민간전승’과 ‘민속의 변천과정’이 반영된 것이다. 그런데 일본의 기층문화가 외래문화임에도 불구하고 일본민속학은 동아시아와 일본의 문화적 계통관계를 외면하고 ‘일본’이란 제한된 범주로 민속을 연구해 왔다. 마찬가지로 무형민속문화재 지정 기준에서도 동아시아 민속과의 연관성이 과소평가되고 있다. 범아시아적인 관점의 민속문화재 시책이 요구된다.
