In the the 243suit of criminal law, it prescribes that certainly it has to have the participant when the inspection or judicial police officer questions the suspect. However, most of the inspection or judicial police officer questions the suspect independently. The basis of participation duty regulation is the Daejung criminal law of Japanese. But there is no country putting the participation regulations duty in the U.S. United Kingdom, Germany, France, Japan, and etc. Only in China, over two people has to question the suspect. If suspect interrogation is done independently without participant under current law system, it takes care. Problem can be generated the filing of complaint, admissibility of evidence non- recognition of the interrogation report, violation numeration, fleeing of the suspect, self-injury, injury and etc. In order to conclude this problem, it is needed that the abolition of 243 suit of criminal law, change to Court-oriented trials and expansion of the presence of attorney, participation of the people concerned, expansion of the statement video recording room, the increase of the personnel of Judicial police officer and etc.

형사소송법 제243조에서는 검사나 사법경찰관리가 피의자를 신문할 때는 반드시 참여자를 두어야 한다고 규정하고 있다. 그러나 대부분이 단독으로 피의자신문을 하고 있는 것이 현실이다. 피의자를 신문할 때 입회자를 두도록 한 것은 일본의 대정 형사소송법이다. 그러나 현재 미국, 영국, 독일, 프랑스, 일본 등 어느 나라의 형사소송법에도 피의자를 신문할 때 참여자를 두어야 한다는 규정은 없다. 다만 중국에서만 피의자를 신문할 때 2명 이상이 하도록 하고 있다. 현행법 체제하에서 참여자 없이 단독으로 피의자신문을 하게 되면, 민원제기, 피의자신문조서의 증거능력 불인정, 위법수사, 피의자의 도주, 자해, 위해 등의 문제가 발생할 수 있다. 이러한 문제를 해결하기 위해서는 형사소송법 제243조의 폐지, 조서중심주의에서 공판중심주의로의 전환, 변호인 참여의 확대, 가족 등 이해관계자의 참여, 진술녹화실의 확충, 수사 인원의 대폭 확충 등이 필요하다고 생각한다.
