According to juvenile laws, juvenile offenders are subjected to measures such as probation and reprieve of prosecution on condition of guidance counseling. However, seeing that there is limitation in current justice system towards preventing repeat offenses of juvenile delinquents, the police has introduced diversional approaches that include release on condition of guidance, expert participation during the interview of minors, and operation of guidance review committee. Guidance program of police can be divided into two parts: programs operated by the local police precincts themselves and those commissioned out to youth counseling support centers. Under the evaluation where the current precinct-based programs lack in expertise, the police is currently in the process of devising standardized guidance program. However, while the recidivism rates of juvenile offenses still remain on the high level, ages of offenders are getting lower and the natures of such offenses are becoming more brutal. Mainly focusing on diversion policies like measures taken by guidance review committee towards first-time juvenile delinquents that are linked to guidance programs, this study aims to examine recent trends in juvenile offenses by analyzing data from the last five years, thus diagnosing some of the issues from both legal and operational aspects. Furthermore, there will be policy-wide recommendation to properly address the aforementioned issues.

소년범에 대해서는 「소년법」에 근거하여 형벌보다는 보호처분, 선도조건부 기소유예 등과 같 은 처우를 하고 있다. 이러한 공식적인 소년사법제도에 의해서는 소년범죄자들의 재범방지에 한 계가 있다고 보고, 경찰에서는 소년범의 낙인효과를 피하고 재범방지를 위하여 선도조건부 훈방 , 소년범 조사시 전문가 참여제, 선도심사위원회 운영을 통한 선도프로그램과의 연계 등 비공식 적 제재를 부과하는 다이버전 정책을 운영하고 있다. 경찰 선도프로그램에는 청소년상담 지원센터 등 외부 단체에 위탁하여 운영하는 ‘사랑의 교실’ 과 ‘경찰관서 자체 프로그램’으로 크게 대별되고 있다. 경찰에서는 경찰관서 자체 프로그램이 전 문성이 부족하고 체계적이지 못하다고 판단하고 2013년부터 ‘표준 선도프로그램’을 개발 중에 있다. 이 연구에서는 우선 현행 경찰 다이버전 정책에 대해 살펴보고, 경찰 선도프로그램인 사랑의 교 실, 경찰관서 자체 프로그램 등의 비교적 고찰과 이들 프로그램의 문제점을 도출한 후 그 효과성 제고를 위한 정책적 제언을 하고자 한다.
