Offenders that is liable to a monetary penalty should pay a fine. Offenders who are in arrears should be detained at the prison as an alternative punishment which is called detention in a prison workshop. But detention in a prison workshop has many problems including of harmful influence of the short-term imprisonment. Many existing studies of it have approached in the legal, human right aspects. Little attention has been given to the social welfare of it and very attempts have been made at the social welfare service approach of it. But what is important in changing punishment is to approach the social welfare approach from the correctional social welfare paradigm. In conclusion, I asserted the interdisciplinary approach including of family social welfare so on against the existing studies which slanted toward the administrative, legal aspects of changing punishment for failure to pay a fine.

형벌의 종류에서 벌금형을 선고받은 범죄자는 정해진 기간내에 벌금을 납부해야 한다. 그러나 정해진 기간내에 벌금 을 미납하게 되면 미납자는 벌금형의 대체형벌인 노역장 유치라는 환형처분을 받게 되는데 문제는 이러한 노역장 유 치제도는 그동안 자유형의 폐해 등 많은 문제점이 노정되어 왔다. 이러한 노역장 유치제도의 문제점에 대하여 기존 의 많은 선행연구들은 거의가 법적, 인권적, 행정적 차원에서 문제점을 접근하여 왔으며 사회복지이론이나 학제적 측면에서 노역장 유치제도의 문제점을 접근하거나 시도한 논문은 거의 없는 실정이다. 그러나, 범죄인에 대한 교정의 중심이 교정복지의 시대로 이행되는 추세에 비추어서 노역장 유치제도의 문제점에 대 한 접근에서 보다 더 중요한 것은 사회복지적인 접근을 하는 것이다. 결론에서는 기존논문들과 달리 가족복지 등 사 회복지적 접근을 통하여 노역장 유치제도의 문제점과 개선방안을 기술하였다.
