This paper deals with issues and controversies with the South Koreancadastre system, in particular problems in the system and means to solvethem. First, the paper discusses cadastre systems in general (II), that isthe concept and legal effect thereof, focusing on how the cadastre differsfrom the land registry. Next comes the current law on the cadastre (III),that is how the laws and regulations defining this system have developed,and the provisions and structures of the current law. Third is the discussionof problems with the current cadastre system (IV). There are three maincategories: Problems with the method of cadastral survey, the problem ofthe principal of the surveys, and the need for resurveys of non-conformingtracts. Next, the paper reviews two cases pertaining to the cadastre (V),discusses problems with the Cadastral Committee (VI), and concludes withbrief prescriptions to improve the system (VII).

이 논문은 우리나라의 지적제도를 둘러싼 몇 가지 쟁점을 다룬다. 그 중에서도 현행 지적제도에 어떤 문제점이 있는지 그리고 이를 어떻게 개선해야하는지를 살펴본다. 먼저 지적제도 일반론을 다루었다(II). 여기에서는 지적의개념 및 법적 의미를 검토한다. 특히 지적공부가 등기부와 어떤 점에서 차이가 있는지를 살펴보았다. 다음으로 지적에 관한 현행 법률로는 무엇이 있는지살펴보았다(III). 지적제도에 관한 법규범이 어떻게 발전했는지, 지적제도에관한 현행 법체계가 어떻게 되어 있는지 개관해 보았다. 나아가 현행 지적제도에 어떤 문제점이 있는지 분석하였다(IV). 크게 세 가지 문제점을 분석하였다. 지적측량방법에 관한 문제, 지적측량주체의 문제 그리고 지적불부합지에따른 지적재조사의 필요성 문제가 그것이다. 이어서 지적에 관한 판결 두 개를 검토하였다(V). 계속해서 지적위원회에 관한 몇 가지 문제를 살펴보고(VI),결론으로서 지적제도의 개선방향을 짤막하게 제시하였다(VII).
