Once an inheritance becomes available following the death of a decedent, the inheritors can get the inheritance according to statutory inheritance system. Although there are various grounds for inheritors to receive the inheritance, a noteworthy one is that it is aimed at securing the livelihoods of remaining family members after the death of a decedent. In other words, the deceased has the responsibility to support the inheritors. According to the theory, even an inheritor who did not fulfill the obligation to support the decedent while he or she was alive is entitled to receiving the inheritance with no sanction. As a result, it would lead to an unfair outcome of being supported by the decedent, even though he or she did not fulfill the obligation to support the decedent. Thus, obligation of support should be strengthened by imposing judicial punishment on those who fail to fulfill the obligation to support by inheritance law. To deal with such individuals, other countries have various legislative measures by depriving inheritance rights according to inheritance disqualification system or inheritance rights loss system. In Korea, however, only contribution system exists as a way to strengthen obligation of support in connection with issue of support and inheritance. Therefore, Korea now needs to explore measures to strengthen obligation of support by imposing judicial punishment on the inheritance rights of those who fail to fulfill the obligation to support the decedent. Thus, this study involves discussion on which system should be adopted to deal with such issue. No matter what system is introduced, discussing the violation of such obligation should take place first, since the applicability of the system is a major issue. In particular, children require much more active support than any other dependents due to their characteristics. Therefore, this study examines the characteristics of children as dependents, along with the content and degree of relevant support. As a way to strengthen obligation of support towards children by inheritance law, this study suggests adopting and implementing inheritance rights loss declaration system.

피상속인의 사망으로 상속이 개시되면, 법정상속제도에 따라 상속인들이 상속재산을 취득하게 된다. 이처럼 상속인이 상속재산을 승계하게 되는 근거로는 여러 가지를 들고 있지만, 그 중에서 주목할 부분은 피상속인 사망 후 남겨진 가족의 생활을 보장하기 위한 것 즉, 상속인에 대하여 피상속인이 부양을 해야 하기 때문이라 는 것이다. 이러한 근거에 따르면 피상속인의 생전에 피상속인에 대한 부양의무를 다 하지 않은 상속인이 있 더라도 상속이 개시되면 상속인이라는 이유로 어떠한 제재도 없이 상속을 받게 된다. 즉, 자신은 부양의무를 다 하지 않았음에도 불구하고 그로부터 부양을 받게 되는 불공평한 결과를 가져오게 된다. 이와 같이 부양의 무를 다하지 않은 자에 대하여는 상속법적으로 상속을 제한함으로써 부양의무를 강화하도록 할 필요성이 있 다. 이에 대하여 각 국은 부양의무를 다하지 않은 경우 상속결격제도를 통하여 상속권을 박탈시키거나 유류분 권 상실제도를 통하여 상속권을 박탈시키도록 하여 각기 다른 입법태도를 보이고 있다. 우리나라의 경우 부양 과 상속의 문제를 연계하여 부양의무를 강화하는 방법으로 기여분제도만을 두고 있을 뿐이다. 이제 우리나라 도 피상속인에 대한 부양의무를 다하지 않은 자에 대하여 상속인의 상속권에 대한 사법벌을 부과하여 부양의 무를 강화하는 방안을 모색해야할 시기에 직면해 있으므로 어떤 제도를 도입하는 것이 좋을지에 대해서 논의 하였다. 어떤 제도를 도입하든지 부양의무를 위반한 경우에 그 적용이 있게 되므로 부양의무의 위반에 대한 기준에 대 해서 먼저 논의가 이루어져야 한다. 특히 아동의 경우 그들이 갖는 특징으로 인하여 다른 피부양자보다 훨씬 더 적극적인 부양을 필요로 한다. 따라서 피부양자로서 아동의 특징에 대한 검토와 그에 따른 부양의 내용과 정도에 대하여 그 내용을 고찰하였다. 그 결과 아동에 대한 부양의무를 강화하기 위한 상속법적 해결방안으로 상속권 상실선고제도를 도입하여 시행할 것을 제안한다.
