During the Colonial Period by Japan, the land survey project was conducted. It had a lot of probrems. Our cadastral system didn’t coincide with the present land situation because the cadastral records have been written on the papers with an old fashioned technology and equipment. So special law on cadastral resurvey was acted in order to get rid of the cadastral discrepancy in 2012. From the legal point of view, I tried to suggest the improvement method of the special law. Some issues about this lawt such as implementation system by and exclusive organization, inspection of land category, managemetn of compensatory amout, filling out new record and methods of registration are introduced. The calculation and adjustment of estimated compensation can not be performed by officially assessed individual land price because the true value of a land can not be evaluated on the basis of the publicly notified individual land price. It should be improvement of a specific legal liquidation method. The traditional 2D cadastre is not able to reflect the exact information about 3D uses.

지적재조사에 관한 특별법은 토지의 실제 현황과 일치하지 않 는 지적공부의 등록사항을 바로 잡고 종이에 구현된 지적을 디지 털 지적으로 전환함으로써 국토를 효율적으로 관리함과 아울러 국민의 재산권 보호에 기여할 목적으로 지난 2011년 제정되어, 2012년 3월 17일부터 시행되었다. 지적재조사에 관한 특별법의 입 법경위와 주요 내용을 정리하고, 주요 문제점을 열거하고 개선방 향을 제시하였다. 우선 조정금에 관한 문제이다. 개별공시지가에 의한 조정금산벙 보다는 감정평가방식에 의하여야 할 것이다. 지 적재조사시에 지적이 토지의 권리관계에 대한 경계, 면적 등을 밝 혀 소유권의 한계를 명확하게 하려는 법지적을 채용하더라도 경 계, 면적의 변경으로 토지이동이 있을 경우에 소유권의 범위에 변 동이 있는지에 관하여는 규정하고 있지 않는 점이다. 토지이용의 고도화는 지하⋅지표⋅공중에 걸쳐 복합적으로 토 지이용이 이루어지고 있으나, 현행 우리나라의 지적제도는 이를 적극적으로 수용하지 못하고 있어, 토지 관리 및 이용상의 시행상 여러 가지 문제들을 야기하고 있다. 따라서 3차원 공간정보의 제 공을 통해 국토의 효율적 이용 및 활용이 가능하다. 이러한 문제 점들의 개선을 통하여 토지이용의 고도화를 촉진하고 토지소유자 간의 경계에 관한 분쟁을 합리적으로 해결하여야 할 것이다.
