The problem of key money is not just an issue in the part of public law but also in the part of civil law. Key money is formed based on an unofficial contract. However, owing to the ambiguous relationship between lesser and tenant, the disputes about the collection and compensation of the key money would become a social issue. The Yongsan Tragic Incident took place in 2009, among other things, for recouping a key money. By this reason, key money compensation became the primary cause for incessant disputes during redevelopment process. The premium system is universally used, collateral to commercial building lease. Therefore in order to qualify for compensation it should be specified in the Land Compensation Act. It is necessary to regulate a shop tenancy and its combinated goodwill as the object of the compensation in the Land Compensation Act clearly and the valuation methods should be regulated in the Act. in the part of private part it is required to control the commercial lease landlord’s restrictions on the transfer under good causes through the amendment of the Commercial Buildings Lease Protection Act.
