“All citizens shall have the right to a healthy and pleasant environment.” is provided in the frontal sentence of Article 35 of Korean Constitutional Law. And “The State and all citizens shall endeavor to protect the environment.” is provided in the backward sentence of Article 35 of Korean Constitutional Law. Accordingly, ｢Law on Prevention and Their Restoration of Mining Damages｣was made in 2005 to prevent environmental damages and deaths caused by development of mining. Korean Mine Reclamation Corporation was established on June 1st in 2006 so as to take full charge of environmental damages caused by development of mining. It is high time that we should meet need for change of social reality and administrative efficiency of business on ‘prevention and their restoration of mining damages’. In this article, the writer tried to reestablish status of｢Law on Prevention and Their Restoration of Mining Damages｣as a fundamental norm by reviewing and analysing full text of it in order to modify it systematically and improve operation plan. Into the bargain, the writer proposed improvement plan in order to contribute to efficient allocation of resources and push forward an enterprise stably

헌법 제35조 제1항 전단(前段)에서는 건강하고 쾌적한 환경에서 생활할 국민의 권리(환경권)를 규정하고 후단(後段)에서는 이를 위한 국가와 국민의 환경보전의무 를 규정하고 있다. 헌법 제34조 제6항에서는 “국가는 재해를 예방하고 그 위험으로 부터 국민을 보호하기 위하여 노력하여야 한다.”고 규정하여 자연재해와 산업사회 에서 생명과 건강을 위협하는 산업시설 및 오염물질 등 환경영역에서의 잠재적 위 험원으로부터 국민을 보호해야 할 국가의 의무를 규정하고 있다. 이에 따라서 광산개발로 인한 환경피해 및 인명피해의 방지를 위하여 2005년 ｢광산피해의 방지 및 복구에 관한 법률｣(이하 “광해방지법”이라 한다)을 제정하고 (2006. 6. 1. 시행), 광해방지법 제31조 제1항에 근거하여 광산개발로 인한 환경피 해문제 등을 전담하는 “한국광해관리공단”을 2006. 6. 1. 설립하게 되었다. 그러나 사회현실의 변화와 광해방지사업의 행정적 효율성에 대한 요구는 광해방지법의 새 로운 정비를 할 시기에 도달하였다. 이 연구는 광해방지법의 체계적인 정비와 더불어 광해방지사업의 운영 방안을 개선하기 위해 광해방지법 전문을 검토ㆍ분석하여 기본규범으로서 광해방지법의 위 상을 재정립하고, 국내외 광업의 지속가능한 개발을 위한 기틀을 마련하며, 효율적 인 자원배분 및 안정적 사업추진에 기여할 수 있도록 개선안을 제시하였다.
