Depending on the phenomenon of rapid industrialization, an influx of population to cities is causing a drastic reduction of rural labor force. This is the biggest crisis in the development of our agriculture and fisheries sector. Due to the shortage of labour in the of our agriculture and fisheries sector, agriculture and fishery workers and agricultural and fishery managers are continuously increasing working hours and labor strength. On the other hand, agriculture and fisheries in the areas of workforce shortage is getting worse. Since the global financial crisis in 2008, agriculture and fisheries sector due to the global recession and domestic recession is being continually shrink. With signed up U.S.-Korea FTA, Korea-EU FTA, Korea-Chile FTA, the competitiveness of our agriculture and fisheries sector is shrinking. Launched the new Government, economic growth is to increase by activating areas of agriculture and fisheries. Activated the competitiveness of our agriculture and fisheries sector, weget out to solve the crisis of increasing food security and will continue to remain stable the competitiveness of agriculture and fisheries sector. Today, the enactment of ｢Law for supplying Labor of Agri-fishery Sector ｣ will increase the competitiveness of agriculture and fisheries sector. Therefore, the enactment of ｢Law for supplying Labor of Agri-fishery Sector ｣ is very important. This paper propose on the basis of the the rationale for the enactment of ｢Law for supplying Labor of Agri-fishery Sector｣ and the effectiveness of legislation that is acceptance of the contents of the other law for supplying Labor.

급속한 산업화현상에 수반한 도시로의 인구유입에 따른 우리 농어촌의 고령화와 인구감소의 원인은 농어촌노동력의 급격한 감소를 초래하였다. 이는 우리 농어업분 야 발전의 가장 큰 위기의 원인으로 작용하고 있다. 농어산업분야에서의 노동력부족현상으로 인해 농어업종사자 및 농어업경영인은 노동시간과 노동강도가 지속적으로 증가하는 상황에 직면하고 있는 반면, 농어업분 야의 인력부족현상은 점점 더 악화되고 있는 상황이다. 2008년 미국발 세계금융위기 이후 글로벌 경기침체에 따른 국내농어업 분야의 침체, 농어산업영역의 축소경향 그리고 한미 FTA, 한EU FTA, 한칠레 FTA 체결과 함께 우리의 농어업분야의 경쟁력은 계속 위축되고 있는 현실이다. 새정부의 출범과 함께 시작된 경제성장동력강화의 일환으로 농어업분야를 활성 화하여 갈수록 심각성을 더해가는 식량안보의 위기를 대비하고 농어업분야의 산업 경쟁력을 안정적으로 유지하기 위해서는, 농어업 근로인력의 수급조절을 위한 ｢농 어업 인력지원에 관한 법률｣의 제정이 시급하다고 볼 수 있다. 이 논문에서는 동법 률의 제정을 위한 법이론적 근거를 마련하고 타법과의 체계정합성의 방안을 제시하 고자 한다.
