The purpose of this study is to settle controversy between the organizer and the police on aggregate methods for the assembly and demonstration participants, and to contribute the reasonable advanced culture of the assembly and demonstration and the stable state administration through suggesting the scientific aggregate methods for the assembly and demonstration participants. The followings are the results of this study. First, it is required to scientific on the aggregate methods for the assembly and demonstration participants. 'Cumulative participants' that the organizer accepted has to cooperate actively the police's supervision using police line on the areas where the assembly and demonstration are to be held, and to exact count on inflow and outward flow participants on the areas. 'Real-time participants' that the police accepted has to find segmentation on the areas that Fermi Estimate and scientific technologies such as aerial photography, satellite shot, CCTV, and programs, etc. Second, it is need to express at the same time on the aggregate methods for the assembly and demonstration participants. The aggregate methods for the assembly and demonstration participants based on 'Cumulative participants' and 'Real-time participants' are not comparable, so two methods are expressed at the same time with well defined. (Tentative Name) 'Organizer & Police Council on assembly and demonstration' has to announce 'Cumulative participants' and 'Real-time participants' simultaneously. Third, it is required to settle the reasonable advanced culture of assembly and demonstration. The Organizer has to held the assembly and demonstration in accordance with legitimate. The Police has to secure the organizer's legal assembly and demonstration, and exactly supervise the assembly and demonstration on the based of laws and principles.

본 연구는 집회시위 참가인원 집계방식과 관련한 주최측과 경찰의 상호 논란을 해소하고, 과학 적인 집회시위 참가인원 집계방식 제시를 통해 합리적인 선진 집회시위 문화 정착 및 안정적인 국 정 운영에 기여하는데 그 목적이 있다. 이와 같은 목적에 따른 연구결과는 다음과 같다. 첫째, 집회시위 참가인원 집계방식의 과학화이다. 주최측이 적용하고 있는 ‘연인원 집계방식’은 경찰의 집회시위 개최장소에 대한 관리나 폴리스라인 운용에 적극 협조하고 집회시위 개최장소에 따라 유입 및 유출 인원의 정확한 산정이 필요하다. 경찰이 적용하고 있는 ‘실시간 집계방식’은 페 르미 추정(fermi estimate) 적용장소의 세분화와 항공촬영, 위성촬영, CCTV, 프로그램 등 과학기술 을 활용한 실시간 참가인원 집계방법을 모색해야 한다. 둘째, 집회시위 참가인원 집계방식의 병행 표현이다. ‘연인원 집계방식’과 ‘실시간 집계방식’에 근 거한 집회시위 참가인원 집계는 상호 비교대상이 될 수 없으므로 두 집계방식을 명확히 정의하여 병행 표기할 필요가 있다. 집회시위 참가인원 집계를 위한 (가칭)‘주최-경찰 집회시위 협의회’를 운 영하여 주최측과 경찰 간의 충분한 협의와 이해를 통해 ‘집회시위 연인원’과 ‘집회시위 실시간 인 원’을 산정하고 공표하여야 한다. 셋째, 합리적인 선진 집회시위 문화 정착이다. 주최측은 집회시위를 합법적인 기준에 따라 준비, 개최, 그리고 해산하는 과정을 충실히 이행해야 한다. 경찰은 주최측의 합법적인 집회시위 개최를 보장하고, 법과 원칙에 근거한 엄정한 집회시위 관리가 병행되어야 한다.
