The content of article 3 in SPS agreement is too vague. Because that article is trying to balance between countries who want to strict harmonization among member countries regarding SPS measures and countries who want to have discretion on deciding SPS measures. According to the article 3 of SPS agreement, member of WTO has a option to choose SPS measures among which is based on international standards, conform to international standards and deviating from international standards. So, there is no duty to comply with international standards. SPS measures just based on international standards has not benefit which is presumed to be consistent with the relevant provisions of SPS agreement and GATT 1994. But SPS measures conform to international standards shall be presumed to be consistent with the relevent provisions of SPS agreement and GATT 1994. If a member want to introduce or maintain SPS measures deviating from international standards, that SPS measures should be supported by risk assessment as article 5 in SPS agreement. So for facing with the future SPS dispute, government has to develop our professionalism for risk assessment.

SPS협정 제3조는 불명확한 내용의 조항이다. 국가 간 SPS조치의 엄격한 조화를 추구했던 국가들과 국가의 SPS조치 권한의 자유재량을 원했던 국가들 사이에 충돌이 있었기 때문이다. SPS협정 제3조 에 따르면 WTO회원국은 국제기준에 기초하는 SPS조치, 국제기준에 합치하는 SPS조치, 국제기준 보다 엄격한 SPS 조치 중 하나를 선택할 수 있다. 국제기준에 기초하는 SPS조치의 경우 국제기준에 합치하는 SPS조치와 같이 SPS협정 및 GATT의 관련 규정 즉 제20조(b)에 합치하는 것으로 추정되는 효과는 누릴 수가 없다. 다만, 제5조 제8항에 따 른 SPS조치에 대한 해명을 제공할 의무로부터 면제된다고 해석할 수 있다. 국제기준에 합치하는 SPS조치의 경우 SPS협정 및 GATT의 관련 규정과의 합치성이 추정된다. 이러 한 추정은 반증 가능한 것이다. 합치성 추정의 범위에 대하여는 모든 규정이라는 견해와 GATT의 경 우에는 제20조(b)만을 의미한다는 견해가 있다. 두 견해 모두 사실상 결론은 동일하여 논의의 큰 실 익은 없으나, GATT 제20조(b)의 구조상 후자가 타당하다고 보인다. 국제기준보다 엄격한 SPS조치를 시행하기 위해서는 제5조 제1항부터 제8항까지의 관련 규정에 따 라 적절하다고 결정하여야 한다. 즉 제5조에 따른 위험평가 요건을 충족하여야 한다는 요건이 있다. 국가의 과학적인 역량이 그러한 위험평가 요건을 충족하지 못하는 경우도 발생할 것이고 반대로 충 분히 그러한 요건을 충족하는 경우도 있을 것이다. 향후 발생할 수 있는 유사사례에서의 대응을 위해 서는 정부가 장기적인 계획과 안목을 가지고 과학적 전문성을 증진시켜야 할 것이다.
