According to the Treaty on Europen Union (TEU) and legal references, the Presidential elections of the European commission are composed with three steps. The first is the nomination of a candidate by each European Political Party. The second is the campaigning by the candidates. Finally the procedure prescribed by article 17. 7 of TEU. Even if the first step is regarded as the internal procedure of each European Political Party, it includes important activities in order to communicate with national Political Parties, Member states, the EU and citizens. During the second step of the campaigning by the candidates, the Political parties and their candidates will be able to mount a significant European-wide campaign. On the legal perspectives, EU should monitor and enhance the efficient conduct of the European elections and to remove the obstacles to EU citizens voting rights. The article 17. 7 of TEU prescibes the final steps : The proposition of the candidate to the European Parliament by the European Council, Election by the European Parliament, Vote of consent by the European Parliament and Appointment by the European Council. This Presidential elections of European commission should result in the direct vote by the EU’s citizens. Furthermore, it clarifies the EU’s governance of the parliamentary political system and accelerates the europeanisation and the integration of the European Union.

유럽연합조약과 관련규범에 따르면 유럽 집행위원장 선거는 3차례의 시기로 진행된다고 할 수 있다. 첫 번 째는 유럽정당에 의한 예비후보자 공천 시기이며, 두 번째는 유럽의회 의원선거기간 동안의 후보자 선거운 동 시기로서, 이는 유럽시민의 측면에서 보면 집행위원장 선출과정에의 참여 시기라 할 수 있다. 세 번째 시 기는 유럽연합 주요기관들의 정치적 참여에 의한 선출과정이라 할 수 있으며, 유럽정상회의에 의한 임명에 의해 종료하게 된다. 첫 번째 시기는 유럽정당 내부 공천의 기간이지만 유럽정당이 유럽연합 및 유럽시민과 소통하는 기간이며, 예비후보자가 유럽의원 선거기간 동안 주도적 역할을 행할 것이므로, 그 중요도가 높아가고 있다. 두 번째 시기에 해당하는 예비후보자의 선거운동 시기는 회원국과 유럽시민을 상대로 하는 예비후보자와 유럽정당의 활동 기간이라 할 수 있으며, 제도적 관점으로는 유럽시민이 보다 용이하게 선거권과 피선거권 을 행사할 수 있도록 하는 지원방안을 모색하는 것이며 나아가 유럽의회 의원선거제도를 명확히 하는 것이 라 할 수 있다. 세 번째 시기는 유럽연합조약(TEU) 제17조 제7항이 규정하고 있는 절차를 이행하는 시기로서, 유럽정상회 의에 의한 후보자 제청단계 – 유럽의회의 표결에 의한 선출단계 – 집행위원장을 비롯한 집행위원 전체에 대한 유럽의회의 신임단계 – 유럽정상회의의 임명단계의 절차가 예정되어 있다. 유럽연합조약(TEU)에 따른 집행위원장 선출방법은 가히 개혁적인 것이라 할 수 있다. 첫째 집행위원장 선 출방법이 우회적이기는 하지만 유럽시민의 직선제를 도입한 것으로 볼 수도 있으며, 둘째 유럽연합의 거버 넌스를 의원내각제적 성격으로 명확히 한 점, 셋째 유럽정당에 의한 예비후보자 선출 · 유럽시민에 의한 선거 · 유럽연합 주요기관의 참여를 통하여 범 유럽적 통합을 시도하고 있는 점 등을 이유로 제시할 수 있다.
