This study has tried to examine the validity of free nursery policy expanded by the Korean government and its ills in the same light of the harmful effects from regulations in education. The paramount features of government regulations in economic spheres, as the paper has shown, can be applied to those in free nursery policy as well as educational policies. Particularly, there are found the harmful consequences from government regulations in free nursery policy, such as vicious circle of regulations switched with government interventions, indiscriminate price control, the limit of parent’s choice and moral hazard. In order to prevent the evils of regulations accompanying free nursery policy to be enforced and expanded by the under its universal principles which cannot be seen as those of fairness, the paper finally has suggested some recommendations for deregulation.

이 논문은 현재 우리나라에서 보편적 복지를 명분으로 추진하는 무상보육 전면 실시 정책의 실태와 폐해를 규제의 관점에서 검토한 것이다. 그 결과 경제학에서 다루어져 왔던 각종 규제와 그 폐해가 무상보육 전면 실시 과정에서도 그대로 드러났다. 무엇보다도 가격규제가 다른 규제를 반복적으로 불러오는 규제의 악순환 양상과 그로 인한 폐해가 재생산되는 양상을 보였다. 그 양상은 규제와 정부 간섭의 악순환, 일률적인 가격규제, 선택권의 제한, 도덕적 해이와 같은 병폐를 드러내고, 결과적으로 분배정의의 측면에서도 공정하지 못한 결과를 야기한다. 끝으로, 중요한 정책제안으로 보육정책의 수익자 부담원칙 수용, 잔여형 복지정책 도입, 민간과 공공보육시설 간의 역할 분담 및 민간 보육시설의 자율권 확대를 제시하였다.
