This study looked into the establishment of ‘Okansugye’ system for the operation of penal administration during the process of strengthening laws in the late Joseon Dynasty and compiling Chuchogyeoloklok(秋曹決獄錄) as its outcome, and the characteristics of its data. The government standardized the system of writing official records of criminal cases, and compiled those official records cases into books. It ordered the Ministry of Justice and Euigumbu to make a book from the already decided official records of criminal cases, and Nanggwan(郎官) of the Ministry of Justice abstracted and reviewed them by year to compile Chujogyeoloklok. Chujogyeoloklok included the edited criminal case records during the reign of King Cheoljong and King Gojong, and mainly recorded Gyemok(啓目) of the Ministry of Justice and government offices, records of criminal investigation, Gyeokjaeng wonjeong (擊錚原情), Gyebon(啓本) about exiles and murder cases, amnesty documents, and Jeongyo(傳敎). In short, since Chujogyeoloklok recorded and complemented the key points of important documents accompanied in all processes where the king’s verdict regarding one case is passed, it served as the integrated system of criminal Gyeolokjib. This book can be valuable for more in-depth approach about relations between the nation’s social control and crime as well as national observation and the public’s deviation through basic review of traditional criminal theory and specific causes and effects of crimes.

본 논문에서는 조선후기 법치가 강화되는 과정에서 나타난 형정 운영 중 옥안수계제도 의 정비와 이에 대한 결과물로서 ｢추조결옥록｣이 편찬되는 과정 및 자료적 특성을 살펴보 았다. 국가는 옥안의 작성방식을 통일하여 문서의 체계를 일원화시켰으며, 녹계 옥안을 책자로 만드는 작업을 진행하였다. 이미 판결한 옥안을 책자로 만들어 기입하도록 형조와 의금부에 명령하였고, 형조의 낭관은 이를 연도별로 나누어 초록, 편집하였는데, 그 결과 물이 ｢추조결옥록｣이다. ｢추조결옥록｣에는 철종대와 고종대의 형사사건 기록이 주로 편집 되어 있으며, 형조의 초기 및 계목, 각 사의 계목 및 수본, 심리 옥안, 격쟁 원정, 유배 및 살옥죄인에 대한 계본, 전국의 방․미방수계성책, 왕의 전교 등이 기록되었다. 즉 ｢추조 결옥록｣은 한 사건에 대해 왕의 판부가 나오게 되는 모든 과정에서 수반된 중요한 문서의 요점을 함께 기록, 보완함으로써 형사결옥집의 총합체로서의 구실을 하였다. 이를 통해 당시 전통 형법이론에 관한 기초적인 검토 뿐 아니라 범죄행위의 구체적인 인과과정을 통해 국가의 사회통제와 범죄와의 관계, 국가의 감시와 민의 일탈 등에 대해 보다 심층적 인 접근을 하는데 자료적 가치가 있다고 할 수 있다.
