The portions inherited to an inheritee’s spouse shall be increased by fifty percent over the inherited portion of his or her lineal descendant, where he or she inherits jointly with his or her descendants, or fifty percent over the inherited portion of his or her lineal ascendant, where he or she inherits jointly with his or her lineal ascendant. For that reason an inheritee has two or more inheritors, the inheritance of spouse are not enough for the rest of spouse’s life. So some scholars publish the results of his or her research work until now. If we pay due regard to the spouse’s convenience, the spouse may be have the right for the utilization of all inheritance, I think. Though this method is not disadvantageous to other inheritors, spouse may have enough property for his or her remaining years. I think this is the best way for country or community, if spouse do not have enough money, country or community have to help him or her. And the descendant inherited the inheritee’s inheritance from spouse after spouse being dead.

피상속인이 사망한 경우 그 배우자는 공동상속인인 직계비속 또는 직계존속에 비하여 5할의 재산을 더 상속하게 된다. 그렇지만 고령화 사회가 되면서 배우자는 현재와 같은 상속분에 따 라 상속받은 재산만으로는 여생을 보내는 것이 힘들게 되었다. 물론 피상속인의 직계비속이 직계혈족인 배우자를 부양할 의무를 부담하고 있기는 하지만 현실적으로 자녀가 부모를 부양 하는 것이 점차 어려워지고 있고, 국가에 의한 부양도 많은 비용이 소요되기 때문에 힘들어지 고 있다. 그리하여 현재와 비교할 때 더 많은 상속재산이 배우자에게 귀속될 수 있도록 해석론 또는 입 법론을 통하여 배우자에게 더 많은 상속분을 인정하려는 노력이 이루어져왔다. 최근에는 상속 분에 관한 규정을 개정하여 배우자의 상속분을 증가시키려는 노력도 이루어지고 있다. 그렇지 만 배우자의 상속분을 증가시키면 다른 공동상속인의 상속분이 감소하기 때문에 그 합의점을 찾는 것이 매우 어려웠다. 그래서 유언이나 신탁에 의한 상속을 인정한다는 전제에서, 배우자가 상속재산 전체를 이용할 수 있는 권한을 가질 수 있도록 입법하는 것을 제안한다. 물론 다른 상속인에게 불리한 점이 있기는 하지만 배우자에 대한 부양의무를 면할 수 있다는 점에서는 선택할 수 있는 방안이라 고 생각된다. 다만 피상속인의 재산에 대한 이용권을 가진 배우자가 재혼을 하는 경우나 계모 자관계에 있는 자녀가 있는 등의 예외적인 상황에서는 상속재산에 대한 이용권을 박탈하거나 제한할 수 있는 장치가 마련되어야 할 것이다.
