Since the final execution on December 30th, 1997, Korea has not conducted death penalty. Hence, Amnesty International currently classifies Korea as the “abolitionist in practice.” On the other hand, however, the Constitutional Court of Korea ruled the death penalty as constitutional in 2010. 5 out of 9 justices ruled the penalty as constitutional and the other 4 ruled it as unconstitutional. However, the Constitutional Court barely mentioned the brutality of capital punishment in the ruling. According to Amnesty International, only 10 nations conducted hanging in 2011. Among G20 members, Japan and India were the only countries that conducted hanging in the 21st century. The reason why only few countries choose hanging is because it is very brutal. Recently in Japan, the controversy over the brutality of hanging is arising. Opponents to the capital punishment say that hanging gives unnecessary pain to a condemned criminal, can separate a head with a body, and looks extremely inhuman from the public’s point of view.
Discussing the unconstitutionality of death penalty, it is essential to deliberate on the brutality of capital punishment. Through this paper, I am going to conduct a through research into the brutality of hanging.

1997년 12월 30일의 집행을 마지막으로 우리나라는 사형집행을 하지 않고 있다. 그리하여 국제 앰네스티(Amnesty International)는 우리나라를 사실상의 폐지국(abolitionist in practice)으로 분류하고 있다. 한편, 헌법재판소는 2010년 존치의견 5, 위헌의견 4로 사형제도에 대해 합헌결정을 내렸다. 그러나 사형제도 의 잔혹성은 거의 언급하지 않았다. 국제 앰네스티에 의하면 2011년 교수형을 집행한 국가는 10개국에 불과하며, G20 참가국 중애서 21세기에 들 어서 교수형을 집행한 국가는 일본과 인도뿐이다(Amnesty InternationalⅠ). 이렇게 교수형을 채용하는 국가 가 적은 것은 교수형이 잔혹한 집행방법이기 때문이다. 최근 일본에서는 교수형의 잔혹성에 대한 논쟁이 일고 있다. 교수형이 불필요한 고통을 주고 있으며, 목이 잘 려나가는 경우가 있고, 일반인의 관점에서 대단히 잔혹하다는 것이다. 사형제도의 위헌성을 논할 경우, 교수형의 잔혹성에 관해서 심도 있게 다뤄야 한다. 본고에서는 교수형의 역 사적 고찰과 함께, 국내외 문헌 연구를 통해 교수형의 잔혹성에 대하여 고찰하고자 한다.
