The purpose of this paper is to critically reexamine the imprisonment system and to propose directing points for a new punishment system. Chapter 2 analyses the essential problems of the prison system from three critical perspectives. First, is it proper for us to restrict the ‘time and space’ of prison inmates for their crimes in such fast-changing times? Second, can the prison system truly get rid of the causal elements of crime? Third, was the prison system established to actually realize a humanistic ideology for the rehabilitation of wrondoers? Chapter 3 presents four concepts for the paradigm formulation of the new punishment system. They include ‘good people vs. bad people’, ‘inside and outside’, ‘the limitations of restorative justice’, and ‘the ethics of others’. Finally, chaper 4 proposes ‘peacemaking corrections’ as the ideal directing point to set up through the systematization of such concepts.

본 연구의 목적은 오늘날 형벌제도의 대표적인 유형인 구금형 제도를 본질적인 측면에서 재조명하고 새로운 형벌체계의 지향점을 제시하는 데 있다. 먼저 세 가지 비판적 관점에서 교도소의 본질적 문제점을 분석한다. 첫째, 급속한 변화의 이 시대에 죄의 대가로서 시간과 공간을 속박하는 것이 과연 적합한 것인가? 둘째, 범죄의 원인을 제거해야하는 당위성을 가진 교도소가 과연 범죄유발요인들을 제거할 수 있는가? 셋째, 교도소가 교정교화라는 인본주의적 교정이념의 실현을 위해 설립되었는가? 다음으로 새로운 형벌제도 패러다임의 정립을 위한 개념으로서 ‘좋은 사람 vs. 나쁜 사람’, ‘안과 밖’, ‘회복적 사법의 한계’, 및 ‘타자윤리학’을 제시한다. 끝으로 이러한 개념들의 체계화를 통해 정립될 수 있을 것으로 기대되는 이상향적 지향점으로서 ‘평화교정학(peacemaking corrections)’을 제시한다.
