To see the EU’s cooperation or harmonization to curb the nuclear danger in the region, we constructed a simple tort model to explain the transboundary nuclear damage. Using the bench mark model, we tried to explain some nuclear safety regime at the EU level. Among complex features of nuclear energy safety, we focused upon two key instruments: the ex ante regulatory safety standard and the ex post nuclear liability rule. Using a Coase framework, we attempted to explain why the EU region’s nuclear safety negotiation is incomplete in correcting transboundary harms and how EU countries have developed incomplete but unique safety cooperation. Strict and limited liability rule has been the norm in the third party liability of nuclear accidents. Also in case of safety standard regulation, the countries have committed to a loose but legally binding regional agreement to harmonize regulatory regime at the EU level.

지역의 원자력 사고 위험을 통제하기 위한 유럽연합의 협력 제도를 보기 위하여, 우리는 초국경 원자력 피해를 설명하는 간단한 불법공동행위 모형을 구축하였다. 이를 이용하여 유럽 연합의 다양한 원전 안전 제도 가운데, 특히 두 가지, 즉 사전적 안전 규제와 사후적 배상책임 규제에 초점을 맞추어 설명하였다. 이른바 코즈 정리(Coase Theorem)의 틀과 거래비용적 설명을 통하여 초국경 원자력 위험(외부효과)을 줄이기 위한 회원국들의 노력이 불완전할 수밖에 없는 원인과 유럽연합이 국가간 협력을 통하여 현재의“불완전하지만 고유한”안전규제 제도를 만들게 된 과정을 설명하고자 하였다. 사후적 조치로서“엄격책임”과“제한책임”제도는 원자력 사고에 따른 제3자 배상 제도에서는 규범적으로 적용되고 있었으며, 사전적 규제로서 각국은 유럽연합 차원의 통일된 제도를 갖추기 위하여“느슨하지만 법적구속력이 있는”안전협력 제도를 만들어 왔음을 알 수 있다.
