As the trend of globalization accelerates transnational exchanges, there has been an increase of cases where criminals evade prosecution by escaping to overseas countries. Against this backdrop, the Prosecutor’s Office and the Korean National Police Agency(KNPA) is now coordinating with overseas law enforcement agencies in order to repatriate criminals back to Korea. However, due to certain aspects of the extradition treaty, the process of repatriation is often hindered with a variety difficulties and limitations. These limitations, which are directly linked with low repatriation rate of criminals fled to foreign countries, lead towards public distrust and disrespect in regards to the punitive system of a state. This current situation calls for necessity of studies that explores measures to boost the currently meager rate of criminal repatriation. Repatriation process is mainly carried out through criminal expatriation treaties and INTERPOL coordination. In this study, along with theoretical observations regarding expatriation treaty, extradition through INTERPOL and international transfer of sentenced persons, the current status of the repatriation treaty will be examined through the analysis of statistic data of the KNPA as well as the Department of Justice. Measures to boost the repatriation rates as well as suggestions taken from the perspective of correctional welfare will be followed after diagnosing limitations of current repatriation process.

국제화․세계화 추세에 따라 국제교류가 활발하게 되어 범죄자들이 국내에서 불법행위를 저지르고 외국으로 도피하는 사례가 증가하고 있다. 이에 따라 검찰과 경찰은 국외로 도피한 범죄자에 대하여 외국 형사사법기관과의 수사공조활동을 통해 국내송환을 추진하고 있다. 그러나 범죄인인도조약의 성격상 인도에는 많은 제약이 있으므로 국외도피사범의 송환에는 어려움이 따른다. 이로 인해 국외도피사범 송환율은 낮을 수 밖에 없어서 국가 형벌권에 대한 불신 및 경시풍조로 직결될 우려가 있으므로 국외도피사범 송환율 제고를 위한 연구의 필요성이 제기되고 있다. 국외도피사범 송환은 범죄인인도 청구를 통한 송환과 인터폴 공조를 통한 송환으로 대별되는 바, 범죄인인도제도와 인터폴 송환 및 수형자 이송제도에 대해 이론적 고찰을 하고, 이어서 국외도피사범 송환실태를 경찰청, 법무부 등의 통계자료를 토대로 분석하였다. 그리고 이들 실태 분석을 통해 국외도피사범 송환의 문제점을 분석한 후, 송환율을 제고할 수 있는 방안과 교정복지적 방안을 제시하고자 한다.
