Called as forgotten victims and the third victims of crime, the children of prisoners have negative experiences such as depression, anger, low self- esteem, questioning of the criminal justice system and parenting, low academic achievement, delinquency, and crime through their parents' arrest and incarceration. Research reveals that children of prisoners are 2~3 times more likely to commit crimes than other children. Considering children of prisoners as the vulnerable group which needs attention and support, Korea as well as U.S., Canada, and England has been providing support for children of prisoners. In fact, major efforts have been made by correction-related agencies. In spite of police’s important role in supporting children of prisoner, police’s role has been relatively overlooked. Police can have significant influence on children of prisoners in that police is the very first criminal justice system with which children of offenders come into contact. If police makes a rapid and effective response to the critical situation of arrest of parents, children of arrestee will be able to overcome family crisis. Police should develop arrest strategy in which children of offender are taken into consideration. Measures need to be taken in order to ensure who will take care of children. If needed, police should contact child welfare agencies to deal with this issue. It is also important for police to establish data base on children of offenders. This information needs to be shared among related agencies to support children of prisoners. Written guideline including above tasks needs to be develop. Lastly, through the education of police, the important role of police officers in the process of supporting children of prisoners needs to be learned and accepted by police officers.

부모의 범죄성과 부모의 구금이 한 개인이 범죄자가 되는 가장 강력한 요인이 라는 연구결과들이 제시되고 있다.따라서 범죄의 대물림 현상을 막기 위해 국/ 내외 적으로 수용자 자녀에 대한 사회적,국가적 지원이 이루어지고 있다.이러 한 수용자 자녀지원은 장기적인 안점의 범죄예방 정책이기도 하지만 아동의 권 리 차원에서도 이루어져야한다. 1989년에 제정된 유엔아동권리협약에 의해 18 세 이하라고 정의되는 모든 아동은 어떠한 조건과 환경에서도 차별 받아서는 안 되며 보호받아야할 권리가 있기 때문에 범죄자라는 부모의 신분에 상관없이 보 호받고 지원받아야 한다. 각 국가가 행하고 있는 수용자 자녀지원 정책은 주로 교정기관을 중심으로 이루어지고 있어서 상대적으로 경찰의 역할은 간과되어왔다. 그러나 경찰은 수용자 자녀가 접하게 되는 첫 번째 국가 형사사법기관이기 때문에 경찰의 신속하고 효과적인 대응은 향후 수용자 자녀가 겪게 되는 고통과 충격을 최소화 시킬 수 있으며, 부모의 부재 중에도 그들이 올바르게 성장하는 것을 가능케 할 수 있다. 따라서 경찰은 부모의 체포 시 미성년자 자녀를 고려하 고, 체포 후에도 미성년자 자녀가 방치되지 않고 돌봐질 수 있도록 적절한 조치 를 취하고 이러한 사항에 대한 정보를 구축하여 관련 기관과 정보를 공유하여 효과적인 지원이 이루어지도록 해야 한다. 이러한 사안을 담은 경찰 직무지침이 개발되어야 하며, 범죄자의 미성년자 자녀에 대한 지원의 필요성에 대한 교육을 통해 경찰 내부의 이해와 수용을 높여야하겠다.
