Multi-Agency Public Protection Arrangements (MAPPA) are a set of statutory arrangements to assess and manage the high risks posed by certain sexual and violent offenders. They are established by virtue of the Criminal Justice Act 2003 and are designed to bring together the Police, Probation and Prison Services. A number of other agencies such as Children’s Services, Adult Social Services, Health Trusts and Authorities, Youth Offending Teams, etc., are under a duty to co-operate with the Responsible Authority. Offenders eligible for MAPPA are identified and information is gathered and shared about them across relevant agencies. The nature and level of the risk of harm they pose is assessed and a coordinated risk management plan is implemented to protect the public. In most cases, the offender will be managed under the ordinary arrangements applied by the agency or agencies with supervisory responsibility. A number of offenders, though, require active multi-agency management, and their risk management plans will be formulated and monitored via Multi-Agency Public Protection meetings attended by various agencies. As a result, this has a cumulative effect on managing a number of offenders who have high risk of re-offending.

최근 우리 사회에서 발생하고 있는 우범자에 의한 일련의 강력범죄는 우리 사회로 하여금 고위험 범죄자에 대한 불안감에 시달리게 하고 있는 실정이다. 특히 이들을 관리하는 형사사법시스템은 효과성이 낮아 보인다. 즉, 경찰에 검거된 범죄자는 검찰에 송치되고 기소된 범죄자는 법원에 의하여 형이 확정되면, 교정기관 혹은 보호관찰기관에 보내어 일정 기간 동안 격리 혹은 갱생을 위한 프로그램을 거친 후 사회에 복귀하는 과정을 거친다. 그러나 형사사법제도는 고위험범죄자의 재범을 방지하기에 충분하지 못한 것으로 보이며, 범죄자의 수용인원이 증가하는 추세에 있지는 않으나 높은 재범율을 나타내고 있음이 이를 증명해주는 것이다. 교정기관에서 출소한지 3년 이내에 4명중 1명이 재범을 저지르고 있으며, 성범죄는 재범률이 무려 70%를 나타내고 있다 본 연구는 재범위험성이 높은 특정범죄자 즉, 고위험범죄자에 대하여 “다기관에 의한 공공보호협정”(Multi-Agency Public Protection Arrangements: MAPPA)을 활용 경찰, 교정기관, 보호관찰소 등이 협력하여 고위험범죄자에 효율적 관리를 도모하고 있는 영국의 사례를 검토하였다. 다기관 공공보호 협의체(MAPPA)의 도입배경과 개관, 근거법률, MAPPA의 구성 및 운영절차가 검토되었으며, MAPPA 회의의 운영에 관하여 면밀하게 검토하였다. 또한 MAPPA관리 범죄자의 변화 추이, MAPPA관리 범죄자의 준수사항 위반, 그리고 MAPPA관리 범죄자의 재범현황을 검토함으로써 MAPPA운영의 성과에 대해서도 고찰하였다.
