Reintegration of ex-offenders into society is a perennial problem facing the criminal justice system around the world. A successful reintegration of the released requires multi-faceted endeavors, such as providing basic job skills in correctional facilities and cultivating communities to be less harsh for the released criminals. High rate of re-offending among ex-offenders may be caused by individual problems of lack of job motivation and crime-prone attitudes and values as well as lack of employment opportunities for them. Employment is a critical factor for ex-offenders and a better solution to promote economic stability of the released prisoners is necessary. This study proposes the “community restoration model”for ex-offenders’successful reintegration into society. The model is designed to incorporate the roles and responsibilities of various stake-holders, such as ex-offenders, government, social enterprises and the community. It is suggested that social enterprise incorporating and balancing the values of social responsibility and economic profit making be the most appropriate model for the successful reintegration of the released. This study examines various measures to promote ex-offenders’ employment opportunities in the field of social enterprise – a newly developed model of economic entity pursuing both for-profit entrepreneurship and social entrepreneurship. Social enterprises can take various forms and the law regulating them prescribes the identity as engaging in profit-making by providing goods and services and advancing the living quality of the community by providing social services or jobs for socially disadvantaged people. Results from a survey with prison inmates revealed the necessity for ameliorating negative stereotypes towards ex-criminals, being a crucial obstacle for them to find jobs or start a new business after release. Employment policies and programs need be based on their needs and job skills, increasing the success rate of the employment and lessening re-offending rate. Also, a transitional employment assistance program is suggested to help ex-offenders become more responsible for their work by providing a transitional stage of adaptation to job situations. In order to facilitate societal and economic situations for furthering the establishment of social enterprises for ex-offenders, this study suggests the necessity for the institutionalization of new policies and programs for assisting sustainable development of social enterprises by providing management consultation and legal assistance for social entrepreneurs.

재범문제는 세계 여러 나라의 형사사법제도가 직면하고 있는 해결해야 할 난제이다. 출소자의 절반 이상이 출소 후 3년 이내에 교도소에 재수감되고 있다는 사실은 교정을 비롯한 형사사법제도가 효과적이지 않다는 반증이기도 하지만 다른 한편으로 범죄자의 문제는 범죄자를 처벌하고 교정시키는 형사정책의 문제뿐만 아니라 보다 복잡하고 다양한 구조적 문제가 포함되어 있다는 것을 보여주고 있다. 본 논문은 출소자의 성공적인 사회복귀를 위한 형사정책적 패러다임은 범죄자들과 이들을 교정하는 교정기관의 노력만으로는 불가능하다는 전제 아래, 지역사회 관련 당사자들의 사회통합적 관점에서의 노력을 통해 출소자들이 사회경제활동의 주체로서 성공적으로 정착할 수 있다고 보고 있다. 이 글에서 필자가“지역사회회복 모델”이라고 이름붙인 범죄자 사회복귀 패러다임은, 범죄가 일어난 시간과 공간이 지역사회이기 때문에 범죄로 인해 단절되었던 범죄자와 지역사회의 유대와 결속을 다시 회복하고 전과자에 대한 편견이 감소된 시간과 공간 속에서 재통합되고 결속될 수 있도록 하는 지역사회 중심의 사회복귀 모델이라고 할 수 있다. 이러한 관점에서 이 글은 출소자들이 사회적기업이라는 새로운 경제모델 속에서 어떻게 사회복귀를 성공적으로 할 수 있을지 논의하고 있다. 사회적기업은 출소자들의 사회복귀 장애요인들을 극복하고 경제적 목표를 달성할 수 있는 적합한 취업모델이 될 수 있으며 따라서 이 글은 출소자들을 위한 사회적기업의 활성화 방안들을 제시하고 있다.
