The purpose of this study is to review a subject of preparatory investigation by police's personal information proceeding With the Privacy Act for a protect and regulate. The preparatory investigation by police is police work of investigation before the commencement(police charge) for Check crimes based on Crime information the officer is collected or provided by third parties. Preparatory investigation by police is no basis in law, investigation of consent and disposition of forces of goods. Police shall be subject to Privacy Act, Police officers as handlers personal information should handle personal information or Police officers Directed by assistant can be processed. Chief privacy officer of police shall disclose a personal Information File by the Privacy Act. Because Preparatory investigation by police is no basis in law and a violation value set by the law of Criminal Procedure, Justification is not processing of personal information with the Privacy Act. The preparatory investigation by police have no legal basis for sensitive information and unique identification. During preparatory investigation by police, criminal information system to provide personal information not allowed processing personal information elsewhere, also lack the follow-up. 본 연구는 피내사자의 개인정보를 처리하는 수사이전의 경찰내사에서 개인정보보호법 적용을 통해 개인정보를 합리적으로 보호하고 규제할 수 있는 방안에 대하여 검토하였다. 경찰내사는 ‘경찰관이 수집하거나 경찰관을 제외한 제3자에 의해 제공된 범죄정보를 기반으로 그에 대한 범죄혐의 유무 확인을 위해 행하는 수사개시(입건) 이전의 경찰 활동’이다. 경찰의 내사는 형식적 법률에 의한 근거 없이 이루어지고 있으며 임의적 조사와 대물적 강제처분이 가능하다. 경찰청은 개인정보보호법의 적용을 받고 개인정보처리자인 경찰관은 자신이 직접 개인정보를 처리하거나 이행보조자 등 다른 사람을 통해 처리할 수 있다. 경찰청의 개인정보보호책임자는 「개인정보보호법」이 공개하도록 정한 개인정보파일에 대해서는 해당 기관의 홈페이지 등을 통해 이를 공개하여야 한다. 경찰내사 활동은 법률에 근거가 없으며 형사절차법정주의에 위반될 소지가 있어 개인정보호법의 개인정보 처리를 위한 정당한 근거로 보기 어렵고, 경찰내사활동에서 민감정보와 고유식별정보에 대한 직접적이고 구체적인 처리 근거는 존재하고 있지 않다. 또한 경찰내사 과정에서 처리된 개인정보를 형사사법정보시스템에서 이용할 수 있도록 제공하는 것은 개인정보보호법에서 허용되지 않은 개인정보의 목적외 이용·제공에 해당하고 그에 따른 후속조치도 미흡하다. 경찰내사에서 피내사자의 경우 개인정보보호법에서 보장하는 정당한 권리행사를 할 수 있는 여지는 희박하다고 보여진다. 따라서 경찰내사에서 개인정보보호를 위해 다음과 같은 개선방안을 도출하였다. 첫째, 경찰의 내사활동을 법률에서 명시한 경찰의 임무를 근거로 치안정보수집활동을 위한 범죄정보 사실확인을 위한 경찰 기능으로 보아, 경찰내사의 개념과 구체적인 업무절차를 재정립하고 하위 법령에서 구체화하여 개인정보보호법에 의한 합법적인 개인정보 처리를 하여야 한다. 둘째, 내사활동에서 지극히 개인의 내밀한 영역이나 사적 영역에 속하는 사항에 대해 확인할 수 있는 민감정보는 원칙적으로 피내사자에게 별도의 ‘동의’를 통해 처리하는 방안을 도입할 필요성이 있다. 셋째, 경찰내사과정에서 생산된 내사사건기록철 등을 형사사법정보시스템에 이용·제공할 수 있는지 여부에 대하여 개인정보보호위원회에 심의를 받아 개인정보의 목적외 이용·제공에 대한 통제를 받아야 하고, 목적외 이용·제공된 개인정보파일 목록을 검색·확인할 수 있도록 하여 개인정보 처리과정의 투명성을 확보하여야 한다. 넷째, 피내사자를 정보주체로서의 지위를 인정하고 내사착수에서 내사종결까지 개인정보보호법에서 인정하고 있는 정당한 권리를 행사할 수 있는 ‘통지’ 절차를 반영하는 것이 고려되어야 한다.
