Power Structure and Budget System : A Comparative Study of U. S. and France Budget Systems

The budget resolution process between the parliament and the administration develops differently depending on power structure, and political environment and custom. The way of determining public willingness is more complicated in the presidential system than in the parliamentary system. In the parliamentary system, the public willingness is determined only in a legislative body, which is why the determination of the administration is considered to be effective only with the confidence of the legislative body. On the other hand, the presidential system settles the public willingness by interaction between the president and the parliament. The representative countries which have developed the presidential power system for 200 years are the U. S. and France. The two countries fostered the system, refusing to accept monarchy. Even though they rule the role and the power of a president under the power structure in a different way, both of them separate general election and presidential election, running the country by the two-horse carriage form. In addition, it is also the same that a president and a parliament secure political legitimacy from the public separately and the president gets out of a symbolic position and exercise substantial power. In the budget system, the U. S. grants almost omnipotent rights to the parliament while France significantly limits its rights related to the budget. In America, the budget is determined through the process of conflicting, negotiating and adapting by the president and the congress. However, in France, the budget bill initiated by the president is settled by the congress easily. In fact, Korea usually focuses its study as to the presidential system on America, with France not being highlighted its experience and development about various constitutional systems after the French revolution. France’s historical experiences have great implications for us, which is why more studies and analyses should be conducted on them.

국회와 행정부 사이의 예산제도는 권력구조에 따라 또 각국의 정치적 환경과 관습에 따라 각기 다르 게 발전하고 있다. 예산에 대한 국민적 의지를 결정하는 방법은 내각책임제와 달리 대통령제에서 더욱 복잡하다. 내각책임제에서는 국민적 의지가 입법부에서만 구현되기 때문에 입법부의 신임 하에서만 행 정부의 의지가 중요하다. 이에 반해 대통령제에서는 권력분립의 이념에 따라 대통령과 입법부의 상호작 용에 의해 국민적 의지가 확정된다. 대통령제 권력구조를 거의 200여년 이상 경험하며 발전시킨 대표적 국가로는 미국과 프랑스가 있는 데, 이들은 모두 국왕체제를 거부하며 대통령제를 발전시켰다. 권력구조 내에서 대통령의 역할과 권한을 각각 다르게 규정하고 있지만, 의회 의원을 선출하는 총선과 대통령을 선출하는 국민투표를 분리하여 쌍 두마차 형태로 국정을 운영한다는 점에서 이들 국가는 동일하다. 대통령과 의회가 각기 다른 방법으로 국민들로부터 정치적 정당성을 확보하고, 또 대통령이 상징적인 지위에서 벗어나 상당한 권력을 행사한 다는 점에서 이들 국가는 모두 대통령제로 불리는 것이다. 예산권력에서 미국은 의회에 거의 전능한 권한을 부여하고 있는 반면 프랑스는 헌법을 통해 의회의 예산권력을 상당히 제한하고 있다. 예산편성에서 미국은 대통령의 예산안과 의회의 예산안이 서로 충돌 하며 정치적 과정을 거쳐 합의·조정되는데 반해, 프랑스는 대통령 또는 총리가 주도하는 예산안이 의 회에서 무리 없이 확정되는 제도를 구비하고 있다. 사실 우리나라에서 대통령제에 대한 연구는 주로 미 국에 초점을 맞추고 있는데, 프랑스 또한 대혁명 이후 200여년에 걸쳐 다양한 헌법적 제도를 경험 발전 시켰다는 사실이 잘 부각되지 않고 있다. 프랑스의 역사적 경험은 우리나라에 시사하는 바가 많기 때문 에 이에 대한 연구와 분석이 더 많이 이어져야 할 것이다.
