KCG(Korea Coast Guard), a central administrative agency responsible for protecting maritime sovereignty of South Korea, is being confronted with a domestic and international marine crimes. Our country, South Korea is surrounded by oceans with 3 sides, and is a proud maritime nation that should advance to foreign country through the sea. Furthermore, the ocean in the 21st century is getting more important as a treasury of natural resources and a growth engine for the nations. Also the national power will depend on the security of maritime jurisdiction and the use of the marine resources. Therefore, stable performed activity and the maintenance of order in the ocean should be provided to maritime workers. However the maritime workers are seriously threatened by rising social conflicts such as problem caused by reduction of the fishing area and even antisocial behavior like crown law offender(murder, violence and fraud cases etc) and special act offender(fishery offender, safety offender, environment offender cases etc). Furthermore, their trend of crimes are getting more broadened, mechanized and intelligent. It makes confuse maritime order and finally will be a big problem to protect the life and property of the people. Even though there are certain marine environment threats, there are lack of social interests regarding prople's livelihood crimes. whereas, there are steady study about variety type of domestic crimes (economic offence, juvenile delinquencies, and several terrorist actions etc) and global marine crimes, maritime terror and also piracy to prevent sequences by causual analysis. There could be a reason that the keynote of people's livelihood crimes in marine environment is different recognition as matter of international concern, and also there is no administrative structure except Korea Coast Guard. However, there still need to be interested about people's livelihood crimes in marine environment regardless of geographic and other external environmental characteristics even though it happens in maritime because it can cause infringement of people's lives. Thus, this thesis will study about the general feature of people's livelihood crimes in our country's marine and propose solutions. And also it expected to be concerned about studies for people's livelihood crimes in marine. Finally, this treatise is expected that this research will contribute to the confrontation realities of People's livelihood crimes and Improvement Schemes in Korea Coast Guard even a little.

우리나라는 삼면이 바다로 이를 터전으로 해서 많은 사람들이 생계를 유지하고 있다. 따라서 해양에서의 안정적인 활동과 질서유지는 중요하다. 하지만 조업구역 축 소 등 어업질서 변화에 따른 구조조정 과정에서 비롯된 사회적 갈등의 증가와 함께 살인, 폭력, 사기 등의 형법범 및 수산사범, 안전사범, 환경사범 등의 특별법범과 같 은 반사회적인 행위로 인하여 해양환경은 심각하게 위협을 받고 있다. 뿐만 아니라 범죄 양상도 갈수록 광역화․기동화․지능화되어 가고 있는 추세이다. 이는 해양질 서를 혼란하게 하여 국민의 생명과 재산을 보호하는데 있어서도 큰 걸림돌이 될 수 밖에 없다. 그러나 이러한 해양환경에도 불구하고 해양에서 발생하고 있는 민생침해범죄에 대한 사회적인 관심은 미흡한 실정이다. 반면, 국내․외에서 발생하고 있는 다양한 유형의 범죄(경제사범, 소년사범, 각종 테러 등)와 각종 국제성 해양범죄, 해양테러 및 해적행위 등과 같은 범죄는 각계의 주요 연구 대상이 되어 그 원인분석 및 예방 책 마련을 위한 꾸준한 활동들이 이루어지고 있다. 물론 이와 같은 이유는 해양이라는 특 수한 환경에서 발생하는 민생침해범죄의 경 우 대체로 국가적․정치적 관심 대상이 아니고, 또한 사실상 해양경찰이외에 의존할 수 있는 행정기구가 없다는 것도 이유가 될 수 있다. 하지만 해양에서의 민생침해범 죄도 국민생활을 침해하여 위협을 주는 행위인 만큼 범죄발생의 지리적․기타 외부 환경적 특성에 관계없이 다각도의 연구와 관심이 필요하다. 따라서 본고에서는 국내에서 발생하고 있는 해양범죄 중 민생침해범죄의 특징에 대하여 총체적으로 이해․분석하고 이에 대한 문제점 및 대응방안을 제시함은 물론 육상범죄 및 앞서 언급한 일부 해양범죄에 편중되어 있는 연구 활동들이 해양 민생 침해범죄 분야로도 확대될 수 있는 계기를 마련하고자 하는데 그 목적을 두었다.
