The taser was introduced for the police to have ascendancy over the violent criminal into the Korea in 2005. The taser is an electric stun gun which allows police to deal with violent people without causing injury or death. This paper investigated factors affecting the use of taser by police. In pre-scanning step, I selected the factors which are taser's safety, lawsuits, additional impact riskiness, manual, education, and legislation by gathering specialist(panel) opinion on the taser. I conducted a survey with 130 korean investigation police. In turn total 122 pieces of questionnaires were available for the statistical hypothesis testing. All of the data were analyzed using both the multiple regression analysis. The results of the empirical test are suggested as follow. (1) It showed that taser's safety, lawsuits of criminal and civil trial and additional impact riskiness affected the negative use of a taser. (2) It showed that the manual about the taser affected the positive use of a taser. Therefore, Korean Police have to consider the factors affecting the use of a taser like taser's safety, lawsuits, additional impact riskiness and manual to lead a positive attitude of investigation police on the use of a taser. Based this survey, Korean Police will have to compensate the defect of policy on taser. But the use of a taser have to be limited and be used in the emergency situations by minimizing violation of human rights. Consequently, the use of taser should have the preponderant role in guaranteeing public safety.

최근 들어 무동기범죄나 흉기사용범죄, 강력범죄 발생이 증가하고 있는 상황에서 이에 적극적으로 대응해야 하는 한국 경찰의 현실은 인권문제, 잦은 민원으로 인한 법정소송 계류 가능성 등의 이유로 경찰장구 사용을 꺼려하고 있는데 이는 결국 시민들의 치안 불안요소로 작용할 수 밖에 없다는 점에서 필요 최소한도내에서의 경찰장구 사용은 필수불가결한 것으로 사료된다. 이에 본 연구에서는 특히 최근 총기 대체장비로 가장 주목받고 있는 테이저 사용과 관련하여 현장 경찰관들의 테이저 사용에 어떠한 요인들이 유의미한 영향을 주고 있는지 실증적으로 연구하여 보았다. 연구대상은 위험한 상황 속에서 범인 검거 임무를 수행하고 있는 형사과 소속 강력범죄를 담당하는 수사경찰들로 한정하였으며, 테이저 사용에 영향을 줄 것으로 예상되는 요인들로 테이저의 안전성, 민․형사상 소송, 2차 충격, 법률, 매뉴얼, 교육 등 6가지로 선별하여 가설을 검증한 결과, 테이저의 안전성, 민․형사상 소송, 2차 충격, 매뉴얼은 현장 수사경찰관들의 테이저 사용에 유의미한 영향을 주고 있는 것으로 확인되었다. 특히, 테이저의 안전성과 민․형사상 소송, 2차 충격은 수사경찰의 테이저 사용에 부정적 영향을 주고 있었으며, 매뉴얼은 긍정적 영향을 주는 것으로 확인되었다. 이에 본 연구결과를 바탕으로 수사경찰의 테이저 사용에 대해 유의미한 영향을 주는 요인들에 대한 대책 수립이나 보완을 통해, 국민의 인권침해를 최소화하는 방향에서 범죄로부터 국민의 안전을 보호하고 필요 최소한도내에서 테이저 사용이 이루어질 수 있도록 하여야 할 것이다.
