Many of korean plagiarism issues only have been ended as disputes whereas those of foreign countries have been taken seriously and settled fairly based on well-established standards and various cases. In cases of visualizing novels, in particular, absolutely nothing has been studied to cover any special factors occurred while reformatting the contents into other into other media. Even though a number of dishonest cases have been revealed, almost none of these cases have been judged as plagiarism. And still copyrights berate use of the original works under this circumstance. The reason why plagiarism should be treated seriously is that it not only encroaches one's right but also right deteriorates cultural industry by damaging the quality of works. And above all thing, the concern that plagiarism itself absolutely does great harm to media consumers is already a good reason to give this the issue the status of significance. In korea, all the lawsuits against plagiarism in novels and dramas have been judged by prosecutors and judges who are laymen in literary expressions. Therefore, it is strongly required that literary researchers conduct comparative analysis on these issues more meticulously. Hence, dotting the i's and crossing the t's on controversial parts by comparing characters, themes and dialogues between the original and the accused plagiarism, this article focuses on how literary meanings have been spoiled during the process of reformatting. With the novel and SBS drama accused of plagiarism, similarities between the twos and how the identical characters and events were damaged while visualizing revealed the seriousness of plagiarism. This researach is to raise awareness about plagiarism many of which only have been ended as 'disputes' without any settlement.

국내에서의 표절 문제는 판례와 기준이 비교적 충실하게 마련되어진 외국과 달리 논란으로 그치는 경우가 다반사였다. 특히 소설의 영상화 과정에서 일어난 표절 논란의 경우 매체 전이로 인해 발 생되는 특수한 사안들에 대한 연구는 전무하다. 수많은 사례가 발생했지만 표절 판결은 거의 없고 저작권에 대한 권리 또한 지켜지지 않고 있다. 이는 관련자들이 표절 방지를 위한 실제적 노력을 제대로 수행하지 못하고 있기 때문이다. 표절 논란 된 사안들이 제대로 해결되지 못하고 방치되는 현실은 결국 창작자의 창작 의지를 꺾고 창작물의 질적 저하를 가져온다. 이에 본고에서는 일차적 으로 어떠한 문제가 논란의 계기가 되고 있는가를 확인하고 이차적으로 이러한 상황 하에서 발생 한 원작 훼손 문제에 대해 살펴보고 있다. 표절은 개인의 기본적인 권리의 침해는 물론 작품의 질 적 저하로 인한 문화산업의 위축과 함께 무엇보다 수용자들에게 가장 큰 피해를 줄 수밖에 없다는 중차대한 현실적 문제에 대한 우려 때문이다. 한국에서 이루어지는 표절논란 된 소설과 드라마의 소송은 문학적 표현의 특성에 관한 한 문외한인 검사와 판사가 모든 판단을 하고 있다. 그러므로 표절 논란 사안에 대한 문학연구자들의 좀 더 면밀한 비교 분석이 절실히 요구되는 실정이라 할 수 있다. 이에 본 연구는 표절 논란 된 작품을 일차적으로 등장인물과 주제와 대사를 중심으로 비 교함으로써 논란의 근거가 된 부분들을 면밀히 살펴본 뒤, 매체 전이의 과정에서 작품이 가지는 문학적 의미의 훼손이 어떻게 일어나고 있는지에 대해서도 조명해보았다. 이를 위해서 표절 논란 된 소설 ｢야누스의 도시｣와 SBS 드라마 ｢아내의 유혹｣을 주 대상 작품으로 삼았다. 두 작품에서 실제적 유사성의 사례와 동일한 사건과 인물이 영상화 과정에서 어떻게 훼손되어 가는지를 살펴보 고 그 심각성을 확인하였다. 이러한 연구를 통해 수많은 표절 소송들이 ‘논란’으로만 소멸되는 현 실의 심각성 제고에 기여하고자 한다.
