Many migrant women in Europe face difficulties not only due to the difference in culture between the Europe and their country of origin but also due to the challenges of having their human rights protected. The hierarchy of power between the westernized societies and the native culture of immigrants and the importance accorded to gender in each culture causes immigrant women to experience two challenges and conflicts: multiculturalism versus feminism, and respect for cultural diversity and gender equality. This paper would like to investigate how European society responds through policies to the customs accommodated and approved by minorities which conflict with the universal human rights of women. For this purpose, this paper intends to review various social debates and policies in Europe regarding the female genital mutilation among the many areas where the universal rights of women and multiculturalism conflict. In order to investigate this subject in depth, this paper discuss the matter by going into the conflict between multiculturalism and feminism.

많은 이주여성의 경우 이주국사회의 문화와 이주자 사회의 문화의 영향 하에 문화적 갈등뿐 만 아니라 인권 보장에 어려움을 경험하고 있 다. 이 과정에서 주류사회와 이주자 집단 사이 에 존재하는 문화적 위계질서와 젠더적 위계질 서라는 권력관계에서 약자의 위치에 처해 있는 이주여성들은 다문화주의 대 페미니즘의 갈등, 문화적 다양성의 존중 대 젠더평등이라는 두 가 지 가치의 충돌과 갈등을 경험하고 있다. 다문 화주의가 내포하고 있는 문화의 다양성의 인정 과 페미니즘이 표방하는 남녀사이에 존재하는 젠더불평등을 극복하고자 하는 두 가지 가치가 충돌하고 갈등을 일으키고 있음을 알 수 있다. 이에 본 논문은 소수 집단이 용인하고 수용하고 있는 문화적 관습 중에 여성의 보편적인 인권과 충돌하는 부분에 대하여 유럽적 차원에서 어떻 게 정책적으로 대응하고 있는지 살펴보고자 한 다. 이를 위하여 무엇보다도 여성의 보편적 권 리와 다문화주의가 충돌하는 다양한 영역 중 여 성 성기절제 논쟁을 통해 다양한 사회적 논의와 정책들을 검토해보고자 한다.
