Despite 930 institutes that operate Special Judicial Police Officer in our country, only the limited number of institutes including the Ministry for Food, Agriculture, Forestry, and Fisheries, Ministry of Employment and Labor, and Ministry of Maritime Affairs and Fisheries, offer self-regulating educational training programs, other than the 1-2 week-long educational training program by the Legal Research and Training Institute, and most of the remaining institutes that operate the Special Judicial Police Officer are currently depending on 1-2 week long educational training by the Legal Research and Training Institute. More seriously, due to incompleteness of the system, the number of people out of 14,000 Special Judicial Police Officers in total who actually participate in educational training courses is regarded to be less than 50% when viewed on the basis of Legal Research and Training Institute. It may be fairly said that the current educational training of Special Judicial Police Officers is in the state of neglect except for some parts. The goal of this study is to examine the problems of the educational training system of Special Judicial Police Officer and to offer the improvement measures. As for the suggestion of the research results, first, since the education by Legal Research and Training Institute and a district public prosecutor's office may be too insufficient, it is necessary for the institutes that operate Special Judicial Police Officer to develop self-regulating educational training program and drastically increase the number of educational training opportunities. Second, it would be desirable for the educational institutes approved by Ministry of Justice to obligate the educational training for Special Judicial Police Officer and increase the educational centers of Special Judicial Police Officer from current seating capacity of 54 to around 100. Third, although the educational training for Special Judicial Police Officer is conducted about once a year in the form of special lecture, it is necessary to .expand it to 'quarterly-basis' at least. Fourth, it would be necessary to re-organize the educational contents to focus on proper investigation procedure, hands-on work and site-oriented educational training, rather than excessively focusing on the theories such as current Criminal Procedure Code [Law]. Fifth, it would be necessary not to just rely on the Legal Research and Training Institute of the prosecution and the program, but rather develop the measures of expanding the educational opportunities by participating in the investigation education courses such as Korea Police Investigation Academy, Police Training Institute, and investigation training courses through the prosecution-police MOU.

국민의 생명과 재산을 책임지는 특별사법경찰(Special Judicial Police Officer)의 교육훈련에 관한 중요성은 아무리 강조해도 지나치지 않는 것이다. 그만큼 교육훈련이 중요하다는 이야기다. 일반사법경찰과는 달리 특별사법경찰(특사경)은 행정공무원 중에서 특사경으로 지명되어 일반행정과 특별사법경찰이라는 두가지 업무를 동시에 수행해야 하는 어려움에 직면해 있을뿐 아니라 전문적 수사능력이 부족한 실정이다. 그 이유는 특사경 지명자에게는 상당한 교육훈련 시간이 필요한데도 불구하고 실제로는 1-2주 정도만 받은 후 바로 현장에 투입되기 때문이다. 현재 특사경 교육훈련은 법무연수원, 각 지방검찰청, 중앙부처 및 지방자치단체에서 이루어지고 있으나 너무 짧은 시간이며, 대부분 형소법 등 이론적 차원에 그침으로써 가장 중요한 현장의 수사실무교육훈련 경험이 절대적으로 부족하다. 특히 특사경을 운영하는 기관이 930여곳이나 되는데 법무연수원의 1-2주 교육훈련 과정을 제외하고 자체적으로 교육훈련 프로그램을 제공하는 곳은 농림수산식품부, 고용노동부, 국토해양부 정도가 고작이며, 나머지 대부분의 특사경 운영기관들은 법무연수원의 1-2주 교육훈련에 의존하는 것에 그치는 실정이다. 더 큰 문제는 제도적 미비로 인해 전체 특사경 14,000여명 중 실제 연중 교육훈련에 참여하는 인원이 법무연수원을 기준으로 볼 때 50%에도 못미치는 것으로 보여진다. 사실상 현재 특사경의 교육훈련은 심하게 표현해서 일부를 제외하면 방치상태라고 해도 과언이 아니다. 이 연구의 목적은 우리나라 특별사법경찰교육훈련제도의 문제점을 살펴보고 개선방안을 제시하는데 있다. 연구 결과 정책제언을 제시하면 첫째, 법무연수원과 지방검찰청 교육으로는 너무 부족하므로 특사경 운영기관들이 자체 교육훈련 프로그램을 개발하고 그 교육훈련기회를 대폭 늘려야 한다. 둘째, 법무부가 승인한 교육기관에서 특별사법경찰 교육훈련을 의무화하고 법무연수원 특별사법경찰 교육센터의 시설을 각 회수당 현재 54명 수용능력에서 100여명 수용규모로 확장함이 바람직하다. 셋째, 현재 지방검찰청별로 특사경을 위해 교육훈련을 연1회 정도 특강형식으로 실시하는데 이를 최소 분기별로 확대할 필요가 있다. 넷째, 교육내용도 현재의 형사소송법 등 이론에 치우치지 말고 적법한 수사절차와 실무수습 및 현장 중심의 교육훈련 위주로 개편해야 한다. 다섯째, 검찰 자체의 법무연수원 시설과 프로그램에만 의존하지 말고 검찰-경찰간의 MOU를 통해 경찰대학, 경찰수사연수원, 경찰교육원 등의 수사교육과정에도 참여하여 교육훈련의 기회를 늘려 주는 방안도 강구할 필요가 있다.
