The simple issue of the internet media’s election news reports can be defined as a confliction of values between the freedom of election campaign and the fairness of the internet election news reports. The main theme here would be what kind of values, the freedom or the fairness, we should prefer when it comes to a confliction, and where we could find the harmonious contact point between those two important values. Here, we should talk about the special characters of the internet and how we would evaluate the freedom of speech in the cyber-world. Furthermore, this article examines the relationship between internet media and election, and examines how these two values can be realized or fulfilled in the future. In the modern societies, the freedom of speech and the freedom of media have been conferred on the people and the mass-media respectively to protect the free criticisms against the strong political powers. The contact point between the freedom of speech and media could be a new public sphere for the critics against gigantic political powers. This article understands that the internet as one of new media can function as a public sphere in cyber-world. Since the internet has been a new method of election campaign, the issue of the protection or guarantee of the fairness of internet media’s election news reports arises. The Korean Constitutional Court’s has decided as unconstitutional the internet real name system by “the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.” Thus, in the internet-world, the self-filtering system or the market place autonomous control should be preferred over the heteronomous control. This article focuses on the current internet election news reports situation during the 19th general election period, and examines the constitutionality of the internet real name system by the Election Act, which can be considered as a subtle and political issue for both Presidential campaign camps.

인터넷 언론의 선거보도라는 쟁점을 극단적으로 단순화하면 새로운 형태의 선 거활동의 자유와 선거보도의 공정성의 충돌 문제로 묘사될 수 있다. 자유냐 공정 이냐 혹은 두 가치가 양립할 수 있는 접점은 어디냐가 주된 화두다. 여기서 우리 는 인터넷의 특성은 무엇인가 그리고 인터넷세계에서 언론의 자유는 어떻게 평가 되어야 하는가의 문제를 거론해야 한다. 그리고 인터넷 언론과 선거와의 관련성을 분석하고 향후 두가치가 어떤 방향으로 실현되어야 하는지를 살펴보아야 한다. 현 대 사회에서 개개국민의 언론의 자유와 언론매체의 미디어의 자유의 참된 의미는 정치권력에 대한 자유로운 비판을 보장해 주려는데 있다. 거대정치세력에 대한 비 판세력의 새로운 공론장(public sphere)이 언론의 자유와 미디어의 자유의 접합점이 다. 여기에 이제 인터넷이라는 새로운 매체가 등장하게 되어 인터넷 언론은 현실 세계가 아닌 가상세계게에서 공론장으로서의 역할을 수행할 수 있게 되었다. 인터 넷이 새로운 선거운동의 매체가 되면서 인터넷 언론의 선거보도의 공정성 담보가 화두가 되었다. 인터넷 언론의 선거보도와 관련된 공정성 담보장치로서의 공직선 거법상의 규정들에 대한 검토를 통해 논의되어야 한다. 인터넷실명제의 위헌판결 을 통해서도 일부 강조된 바와 같이 인터넷 언론은 가급적 자정작용(self-filtering) 혹은 시장자율통제 적합성을 간과해서는 안된다. 이러한 인식 내지 이해의 기반위 에 제19대 총선에서 드러나 인터넷 언론의 선거보도의 현황에 대해 점검하고 나아 가 제18대 대선에서 쟁점으로 부각되는 인터넷 선거보도의 문제, 특히 인터넷 실 명제에 대해 살펴보기로 한다.
