The purpose of this study is to suggest alternative by studying local autonomous entities’ administrative status and their empirical measures for crime prevention in city parks. The case study was conducted to achieve the purpose of this study by analysing Daejeon’s administrative data, previous studies, and press release. The followings are the results of this study. First, it is required to compliance and to enact safety standards of city parks. Administrative action can be enforced by laws. So local autonomous entities should compliance and enact safety standards of city parks based on laws. Second, Crime Prevention Through Environmental Design(CPTED) should be leveraged. CPTED is ruled by the regulations related city parks and green spaces. Local autonomous entities should encourage government officials to understand and to utilize CPTED for crime prevention in city parks. Third, it is required to policing cooperation for the eradication of crime in city parks. Local autonomous entities and police should cooperate closely for crime prevention in city parks because local autonomous entities and police become difficult when crime occur in city parks. Forth, healthy utilization of city parks should be encouraged and strict law enforcement should be carried out. There are two ways to control illegal acts including crimes in city parks and to prevent degradation of city parks such as encouraging healthy utilization of city parks and conducting strict law enforcement.

본 연구는 도시공원 범죄예방을 위한 지방행정 실태와 그 대책을 실증적으로 검토하여 그 대안을 제시하는데 그 목적이 있다. 이를 위하여 대전시가 2012년 수립한 ‘대전둘레산길 및 도시공원 안전사고 예방대책’과 ‘범죄로부터 안전한 도시공원 관리 강화계획’, 그리고 선행연구, 언론자료 등을 중심으로 사례연구를 실시하였다. 이와 같은 연구의 목적과 방법에 의한 연구결과는 다음과 같다. 첫째, 도시공원 안전기준 준수 및 제정이다. 행정작용은 기본적으로 헌법, 법률, 시행령, 시행규칙, 조례 등 법규에 의하여 집행될 수 있다. 도시공원 및 녹지 등에 관한 법률(법률 제10599호)에 근거하여 도시공원은 특별시장·광역시장·특별자치시장·특별자치도지사·시장 또는 군수가 공원조성계획에 따라 설치·관리할 수 있으므로 이를 근거로 지자체 차원에서 도시공원 안전기준 준수 및 제정을 적극 추진하여야 할 것이다. 둘째, 환경설계를 통한 범죄예방(CPTED)의 적극 활용이다. 2012년 12월 11일 신설된 도시공원 및 녹지 등에 관한 법률 시행규칙(국토해양부령 제550호) 제10조(공원시설의 안전기준) ②항에 따라 CPTED의 적극 활용이 필요하다. 이를 위하여 지자체 차원에서 담당 공무원을 대상으로 CPTED에 대한 이해와 활용을 장려해야 할 것이다. 셋째, 도시공원 범죄근절을 위한 치안협력 강화이다. 도시공원 내에서 발생하는 범죄행위는 지자체의 지방행정 상의 문제뿐만 아니라 경찰의 치안행정에 있어서도 심각한 문제가 될 수 있는 사안이다. 따라서 지자체의 지방행정과 경찰의 치안행정이 유기적으로 협조하여 도시공원 범죄예방에 최선을 다해야 할 것이다. 넷째, 건전한 공원 이용의식 유도 및 불법행위 대상 엄정한 법집행 실시이다. 건전한 도시공원 이용을 방해하는 제반 사항을 통제하기 위한 방법으로는 크게 건전한 공원 이용의식 유도와 불법행위 대상 엄정한 법집행 실시로 구분할 수 있다. 최초에 발생하는 불법행위를 계도하거나 처벌함으로써 불법행위의 확산으로 인한 도시공원의 우범지역화 또는 황폐화를 예방하여야 할 것이다.
