Recently, the anxiety about the crime in which 'the motiveless crime ' etc. heinous crime is generated in succession and which the people feel is higher than ever. In proportion to like this condition, through investigation and severe punishment to the criminals is needed to be made. Furthermore Police force must be concentrated on the prevention and repression. On the other hand, it is a question whether policeman have to protect the human rights of criminals. However there is a worry about re-emergence of torture in the process of investigation because of excessive crime repression. The torture case of Seoul Yangcheon Police Station, last 2010 year, shows that those worries does not end up in the worry. In regard this, the European Court of Human Rights adjudicated that torture should be absolutely forbidden even if in order to save the life of victim at risk of life in the case of gafgen. So the sentence confirmed again the importance of the protection of human rights. In this paper, we suggest some counterplans to prevent and protect torture in the process of investigation.

최근 ‘묻지마 범죄’ 등 흉악범죄가 잇달아 발생하여 국민이 느끼는 범죄에 대한 불안이 그 어느 때보다 높다. 그에 비례하여 이러한 범죄자들에 대한 철저한 수사 와 강력한 처벌이 우선시되고 있으며, 이들 범죄를 예방하고 진압하는데 경찰력을 집중할 것이 요구되고 있다. 반면 범죄자의 인권에 대해서는 애써 보호해 줄 필요가 있는가 하는 의문이 들 기도 한다. 그러나 이처럼 범죄 진압에 치중하다보면 자칫 수사과정에서 고문이 재 등장하지 않을까 우려하지 않을 수 없다. 지난 2010년 서울 양천서 고문사건은 그 러한 우려가 단지 우려에 그치는 것만은 아니라는 것을 보여준다. 이와 관련하여 유럽인권재판소는 최근 Gäfgen사건에 대한 판결에서 생명의 위 험에 처한 피해자의 생명을 구하기 위해서라면 범죄자를 고문해도 좋은가라는 물 음에 대해 고문은 절대적으로 금지되어야 함을 지적하면서 인권보장의 중요성을 다시 한 번 확인했다. 이 논문은 이 판결을 살펴보고, 그것을 기초로 우리나라 경 찰의 수사과정에서 발생할 수 있는 고문을 예방 또는 방지하기 위한 방안을 제시 하였다.
