This research is the first attempt to reveal the reason why Korean police officers unofficially close violence cases that officers contact. Utilizing survey data of the 297 police officers in a police academy, we conducted a logistic regression. The results show that both legal and extra legal factors affect the police officers’ decision to officially begin the violence cases. Police officers’s decision are found to be influenced by severity of crime, victim and offender’s willingness to close the case unofficially, victim-offender relationship, offender’s age, and officer’s education level. Contrary to common belief, however, the decisions are not affected by offender’s sex, job, and attitude toward officers. The results support the morphology hypothesis, but do not support other hypotheses including stratification hypothesis, threat hypothesis, and chivalry hypothesis. Implications of the study are presented.

이 연구는 경찰관들이 알게 된 폭력사건들 중 어떤 사건에서 공식적으로 법을 집행하지 않고 피의자를 훈방하는 지를 분석하기 위해 시행한 것으로서, 교육기관에 교육 중인 일선 경찰관으로부터 수집한 총297건의 사례를 로지스틱 회귀분석법을 이용해 분석한 것이다. 분석의 결과, 한국의 경찰관들은 법률에서 요구하는 범죄의 심각도나 피해자의 비공식처리의사 외에도, 비법률적 요인인 가해자의 의사와 심각한 사건에서의 피해자의 의사, 가해자와 피해자의 관계, 가해자의 나이, 경찰관 자신의 학력 등에 영향을 받아 폭력사건의 공식처리 여부를 결정한다는 것이 발견되었다. 이런 결과는 서구에서 형사사법기관의 법집행에 관련된 가설 중 도널드 블랙의 법의 행동이론 중 관계(morphology) 가설은 지지하지만, 다른 가설들 즉 계층가설, 위협가설, 기사도가설 등은 지지하지 않는 것으로 해석할 수 있다.
