Legalization of private investigation (PI) in South Korea seems not to be remote. However, prior studies of private investigation have been lack in the literature, resulting in absence of policy implication of the legalization and development of private investigation systems after the legalization. To address this limitation, the current study was purported to provide policy implications based on findings from analyses of factors affecting citizen's preference for private investigation. Factors examined include citizen's traits, perceptions of PI's investigative skills, morality, and protection of privacy, experiences with PI, attitudes toward personal justice, interests in policing and police system, and neighborhood traits. For analyses, this study utilized data collected from 225 citizen in 2010. Among the factors, attitude towards personal justice and experiences with PI were found to be significant influence on preference for PI. In addition, perception of PI's investigative skills and income levels were found to be important for preference for PI in typical criminal cases. Based on findings, policy implications were suggested.

민간조사제도에 대한 입법 및 합법화 움직임이 근래 자주 나타나고 있다. 많은 선행연구들이 민간조사제도의 도입 및 합법화의 당위성과 모델을 연구하였고, 한국적 실정에 적합한 도입 모델을 발굴·제시하였다. 하지만, 선행연구는 민간조사제도 도입 시 필요한 형사정책 방향 설정에 대한 실증적 연구는 부족하다는 한계성을 내포하고 있다. 이러한 한계성을 극복하고, 민간조사제도 도입에 따른 형사정책 방향 설정을 위한 정책제언을 하고자 본 연구는 225명의 시민들로부터 민간조사관(현 심부름센터 직원 및 그들이 진행하는 업무 등)에 대한 태도(조사 능력, 도덕성, 개인정보보호 등)와 사적정의 구현 성향, 민간조사 사용 경험, 경찰에 대한 태도 등에 대한 설문 응답을 확보하고 이를 분석하였다. 분석 결과, 개인의 사적정의 구현에 대한 태도와 민간조사 사용 경험이 민간조사 선호에 큰 영향을 미치는 것으로 나타났으며, 경찰의 수사능력과 비교하여 민간조사관의 조사능력이 나쁘지 않다고 인식 할수록 민간조사 고용에 긍정적인 태도를 보였다. 이상의 실증적 결과를 토대로, 본 연구는 형사정책 수립 방향에 대한 정책제언을 제시하였다.
