Even though the investigative interviewing is a pivotal activity for successful investigation, it has been rarely developed in Korea. One of the most important things to improve investigation is the development of interviewing skills. In spite of continuing effort by training program, we still can find low quality interviewing of investigators, for example, they have their own assumption for the account of suspect and only try to get confession. So, they sometimes don’t accept suspect’s explanation, because it does not match with their presumption. However, it could lead false confession and ruin the whole investigation. Reid technique is well known in North America but, it is also criticized by many scholars because it is overwhelmingly oppressive and guilt-presumptive, so will lead false confession of innocent people. But, PEACE model does not just concentrate on acquiring confession of suspects and it is intended to find significant, relevant and reliable information from any interviewee. Eventually, we need to change our interviewing standard as PEACE model, so the paradigm of interviewing suspects as a fact-finding procedure. And, throughout implementing mandatory audio-recording for all the interviews, we should fortify the credibility of investigation results.

이 연구는 현행 피의자신문의 기법상 문제점들을 짚어보고, 현재 수사기관에서 교육중인 미국의 Reid Technique과 영국의 PEACE 모델을 비교 검토하여 그 문제점과 특징 분석을 통해 앞으로 우리나라 수사에 있어 피의자신문이 지향해야 할 방향에 대해 제언하고자 한다. 이제까지 수사관들은 피의자신문을 함에 있어 자백획득 위주의 수사관행 속에서 예단과 편견을 갖고, 각종 잘못된 신문기법을 이용하여 조사해 왔고 이는 심지어 허위자백에까지 이르기도 하였다. 이런 문제점을 극복하기 위해 외국의 대표적 신문기법이라 할 수 있는 미국의 Reid Technique과 영국의 PEACE 모델이 현재 수사관들을 상대로 교육되고 있지만, 미국의 Reid 기법은 불확실한 행동분석인터뷰(BAI)에 기초하여 자백을 획득하기 위한 심리적 억압전술이 그 핵심을 이루고 있어 허위자백을 초래할 수 있다는 문제점을 안고 있다. 하지만, 영국의 PEACE 모델은 ‘자백획득’이 아닌 신뢰할 수 있는 ‘정보획득’을 목적으로 하고 있으며 인권친화적이고 윤리적이라는 평가를 받고 있다. 요컨대 우리 피의자신문은 Reid 기법보다는 PEACE 모델을 지향해야 할 것이며, 신문의 목적도 ‘자백획득’이 아닌 ‘정보획득’의 방향으로 전환되어야 할 것이다. 거기에 의무적 녹음제를 도입함으로써 조사에 대한 신뢰와 공정성을 확보할 수 있을 것이다.
