Intoxicated people lose control over normal physical and mental functions due to the influence of alcohol. They are sometimes responsible for social unrest and crime and are often their victims as well. They must therefore come under the control of the police and health care agencies in order to protect their health and safety. However, in South Korea the police at regional units take full responsibility for managing intoxicated people who cause trouble, often in lieu of performing their normal duties of keeping the peace. In this study the conditions and problems involved in the protection and management of intoxicated people and the relevant laws and regulations are researched. More appropriate measures for protecting and managing intoxicated people are then proposed.

주취자는 알코올의 영향에 의해서 사회통념상 정상적인 판단이 어려울 정도로 취한 상태를 의미하며, 방어능력이 떨어지기 때문에 제 3자로부터 절도나 상해, 강도 등의 목표물이 되기 쉽고, 추락사고, 익사사고, 교통사고 및 각종 사고와 질환에 노출되어 있기 때문에 보호받아야할 대상이다. 경찰지구대 업무의 대부분이 주취자 관리 업무이며 주취자들을 관리하는데 일선지구대의 상당한 경찰관이 투입되므로 이로 인한 경찰력 손실로 방범활동이나 순찰활동 등의 민생치안 역량이 약화되어 치안공백이 발생하고 있다. 본 연구에서는 지구대의 경찰관들이 주취자 관리 업무에 있어서 주취자의 상태를 이해하고그에 맞게 적절한 보호조치를 취하여 국민의 안전과 건강에 기여하기 위하여 주취상태에서의 범죄 현황과 주취자 관리 법적 근거를 통한 주취자 관리 및 보호현행에 대해 알아보았으며 주취자 관리의 문제점을 도출하여 개선방안에 대하여 고찰하였다. 또한 일본, 독일, 프랑스, 미국, 영국과 같은 선진국에서의주취자 관련법과 남대전지구대의 현황과 실태를 알아보았다.
