Prior to 2009, the term ‘draft irregularities’ was used to describe exemption from military duties through foul play. However, since the 2009 parliamentary inspection, the terminology was revised to become'military evasion crime, preparing appropriate measures against them, and therefore preventing the ever so sophisticated acts of military evasion crime through hurting oneself. For this end, the paper offered the following as the possible preventive measures : management of a surveillance body solely for military evasion crime, revision of the physical examination regulations, management of selection of the 18 diseases chosen by the Military Manpower Administration(MMA), sharing of medical records with the National Health Insurance Corporation(NHIC), continuous serveillance against access to inappropriate web sites, granting special jurisdiction police authority to the MMA, management of the military resources provided by those who are of great interest for the general public, and granting extra points to those who have fulfilled their military duties. Hopefully, this paper will arouse the awareness of the illegality military duties. Hopefully, this paper will arouse the awareness of the illegality military evasion entails and contribute to eradicating military evasion crime.

2009년 이전까지는 병역 불이행과 관련하여 부정한 방법으로 병역을 회피하는 수단을 병역비리라는 용어를 사용해 왔으나 2009년 국정감사 시부터 범법자의 죄의식을 강화하기 위해 병역면탈범죄라는 용어로 재정립하였다. 본 연구의 목적은 병역면탈범죄의 유형 및 수법을 분석하고 대책을 마련함으로써 지능화되고 진화하는 신체손상을 이용한 병역면탈범죄 행위를 예방하고자 하였다. 이를 위해 병역면탈 감시 전담조직의 설치 운영, 징병신체검사의 규칙정비, 중점관리대상 질환 선정 운영, 국민건강보험공단과의 진료기록 공유, 불건전한 정보사이트의 지속적 감시, 병무청에 특별사법권 부여, 사회관심 병역 관리자원의 중점관리, 병역의무 이행자에 대한 가산점 부여 등을 예방대책으로 제시하였다. 본 연구가 병역면탈에 대한 위법성을 제고 시키고 병역의무 면탈 범죄를 근절하는데 도움이 되기를 바란다.
