The importance of evidence in the digital form is ever growing with the majority of the public carrying at least several different digital devices in their everyday lives; mobile (smart) phones, tabletops, notebook computers, mp3 players, digital cameras, or other such technology. At the same time, rapidly changing world of technology is challenging courts to keep a pace with new laws addressing potential evidence and preserving privacy of its citizen. This phenomenon is common to virtually every country in the world and this is the time we have to conduct a serious review on our legal system on this matter before it is too late. In this paper, I will look into the relevant laws handling digital evidence specifically in the United States. The modern computer system was born in the US in 50’s and today’s cyber world, the Internet, was also created in the United States in late 60’s. Naturally we could say US has richer history of confronting and handling evidence in the digital format than any other countries in the world. Many countries actually have followed footprints of the US in terms of shaping up their legal system in this area for the same reason. Furthermore, this article explores potential paradigm shift in this area to meet dramatically changing environment especially post 9/11.

디지털 증거는 일상생활에서 스마트 기기들의 활용이 증대함에 따라 과학 수사에 있어서 가장 중요한 요소로서 자리잡아가고 있다. 이는 동시에 법원에게는 비약적인 기술의 발전의 부산물인 디지털 증거의 잠재적인 가치를 추구하면서도 개인의 사생활 침해로부터 자유로와야 한다는 새로운 부담을 주고있는 것도 사실이다. 더 늦기전에 이 부분에 대한 고찰이 필요한 실정이다. 본 논문에서는 현대적인 컴퓨터 시스템과 인터넷의 발생지인 미국에서 디지털 증거가 법정에서 자리잡게 된 과정을 살펴봄과 동시에9/11 사태이후 패러다임의 전환을 맞고있는 디지털 증거의 자리와 역활에 대하여 고찰해 보고자 한다.
