Since 19th century, by Bertillon photograph has been used as a monitoring tool and criminal identification method. It is still used as a way to preserve criminal scenes and evidences for a criminal investigation. Many people agree that photograph can be a solid evidence in a criminal investigation since it uses scientific methods like optics and chemistry to record and visualize certain facts and it has been used as a visual evidence in various areas such as art, science, and social study. However, as of late, there are lots of controversies about the role of the digital photograph as an evidence in a criminal investigation because it is easier to be manipulated and forged than Silver Halide photography. This study will focus on the building of the definition and criteria of the forgery and offer solutions; how to takes and manage pictures in order to get rid of the controversies about forgery when digital photograph is used as an evidence for a criminal investigation. I hope the digital photograph can be the role of a certain evidence for a criminal investigation through this study.

사진이 감시의 도구이자 범죄자 식별 방법으로 사용되기 시작한 것은, 19세기 베르티옹에 의한것이며, 오늘날까지 범죄수사를 위한 현장보존과 증거자료로 활용되고 있다. 사진은 객관적 사실을 광학,화학 등의 과학적인 방법을 통하여 시각화 할 수 있는 특성을 가지고 있어서 예술, 과학, 사회 등 여러 분야에서 증거 역할을 해왔기 때문에 사람들은 사진의 진실성을 믿어 의심치 않았다. 하지만 최근에 등장한 디지털기술과 더불어 발전한 디지털 사진은 은염사진보다 조작과 변조가 용이하기 때문에, 증거로 쓰이기에는 불충분하다는 논란의 여지가 있다. 이번 연구에서는 사진의 위변조에 대한 개념을 정립하여 위변조 판별에 대한 기준을 마련하고, 디지털사진을 범죄수사의 증거로 사용할 때, 위변조 논란의 여지가 될 수 있는 부분을 정리, 이를 해결할 수 있는 사진촬영 및 관리방법을 제시 할 것이다. 이번 연구를 통하여 디지털사진이 범죄수사 증거로써의 역할을 할 수 있기를 기대해 본다.
