jurisdiction system involving confirmation powers and a judgment system in which an ordinary military officer possesses authority to be concerned with the justice department are characteristics of Military judicature act which mostly reflect on the special qualities of military criminal procedures. However, the confirmation powers do not have the established systematic limitations and the lack of balancing ability. For this reason, the confirmation powers possess issues of the possible abusion of authority. In addition, the judgment system also includes questions such as the violation of the Constitution for intervening the people's right to have a trial and a formal involvement of the justice who lacks a proper legal knowledge. Hence, among American military judicial system, the introduction of both convening authority system pertaining the code of exclusion for the commander's unlawful intervention and the jury system rendering the security for the defendant's human rights should be able to contribute a desirable development of our military legal system. This development will have positive influence on the progress of military scientific crime detection's procedures and system as meeting well with objective and reasonable character of that.

확인조치권을 가지는 관할관 제도와 일반 장교가 재판부에 관여하는 심판관 제도는 군 형사 절차의 특성을 반영한 군사법원법의 특징이다. 그러나 관할관의 확인조치권은 제도상 한계가 설정되어 있지 않고 견제수단이 미비하여 권한 남용 가능성이 상존한다. 심판관 제도 또한 국민의 재판 받을 권리침해의 위헌성과 법률지식이 결여된 심판관의 형식적 재판 참여의 과제를 안고 있다. 이에 대해 미국 군사법제도의 특징 중 지휘관의 불법개입배제조항을 가지는 소집권자 제도와 피고인의 인권보장이 가능한배심원 제도 도입을 통해 군사법제도의 바람직한 발전을 기대할 수 있다. 이러한 발전은 군 과학수사의 객관적이고 합리적인 성격과 맞물려 그 절차와 제도 발달에도 긍정적인 영향을 미칠 것이다.
