Investigative agencies have recently obtained digital recording equipment and created electronic interview and interrogation rooms to record questioning of criminal suspects with a view to ensuring the prevention of human rights violations. In addition Korea has recently seen revisions of laws pertaining to recording questioning of criminal suspects. In this study, as a way to effectively utilize systems of recording questioning of criminal suspects in order to ensure the prevention of human rights violations, the analysis of non-verbal behavioral cues, a method to detect lies by analyzing non-verbal behavioral cues which may arise from their psychological changes in face and body of suspects when questioned with relevant footages, and statement analysis, that is SVA (statement validity analysis), RM (reality monitoring), and SCAN (scientific content assessment), all of which help detect inconsistencies in statements by analyzing their contents, are introduced. Furthermore, as prerequisites for effective investigative efforts with recording questioning, ① development of proper methods of interview and interrogation, ② creation of standardized questioning rooms for the analysis of behavioral patterns, ③ psychological training for investigators, and ®Í other minor issues such as thorough preparation for investigation and note-taking are proposed.

최근 수사기관에서는 디지털 장비를 도입하여 전자조사실, 진술 녹화실 등을 구비하여 피의자 訊問과정을 영상 녹화함으로써 인권침해를 미연에 방지하고자 하고 있다. 또한 영상녹화 조사와 관련한 법률이 개정되기도 하였다. 본 논문에서는 인권침해방지 목적의 진술영상녹화제도를 효율적으로 활용할 수 있는 방안으로써, 영상 녹화물을 이용한 訊問 시 피의자의 心理變化에서 나타날 수 있는 비언어적 행동양태를 분석하여 진술의 진위여부를 탐지하는 行動徵候分析과 피의자의 진술 내용을 분석하여 진위를 탐지하는 SVA(statement validity analysis)기법, RM(reality monitoring)기법, SCAN(scientific content assessment)기법 등의 陳述分析을 소개하였다. 또한, 효과적인 영상녹화 조사를 위한 선결조건으로써 ①영상녹화에 적합한 조사(면담) 및 신문기법 개발, ② 행동징후분석을 위한 표준화된 조사실 및 신문실 구비, ③ 수사관의 심리훈련, ④ 기타(철저한 조사준비 및 요점노트) 등을 제시하였다.
