The latest industrial espionage has significantly advanced and became more sophisticated. It substantially damages not only the interests and competitiveness of a company, but also those of a country and society. The latest industrial espionage no longer uses the traditional method of stealing or replicating technology. Today, it entices a targeted hard-core of professional with a large amount of money in order to employee him or her. Further, it even establishes a venture company and penetrates its competing company or country. Therefore, this dissertation specifically analyzes various ways of the outflow of technology and provides measures to prevent industrial espionage by taking a legal action in order to protect the outflow of high technology of a company or country.

최근 산업스파이에 의한 범죄유형은 지능화·첨단화하고 있어 그 피해가 어느 특정기업의 경쟁력 손실에 끝나지 않고, 국가와 사회의 경쟁력에도 매우 나쁜 영향을 미치고 있다. 산업스파이에 의한 범죄 수법도 과거의 절도나 복사해서 갖고 나오던 전통적인 방법에서 벗어나 오늘날에는 유출하고자 하는 대상목표의 핵심인력을 고액의 금전으로 유혹, 스카웃 하여 데려 가기도 하고, 심지어는 위장하여 벤처기업을 경쟁 상대국에 설립하여 침투시키는 경우도 종종 있음을 보게 된다. 그러므로 본 논문에서는 위와 같은 기술유출 침해 형태와 원인을 정확히 분석하고, 사전 예방 차원의 보안관리 방안과 함께, 기술이 유출이 되었을 경우에 사후에 법적인 대응방안까지도 제시함으로써 국가가보호하려는 첨단기술이 유출되는 것을 막는데 기여 하고자 하였다.
