According to the data of Ministry of Information and Communications and Ministry of Administration and Autonomy on CCTV legislation, there are 2 million CCTVs nationwide. They install CCTVs to prevent crimes, acquire evidences, insure the safety of facilities, prevent fires and control people entering a building. It expands its application in both public and private sections. Last year Ministry of Information and Communications suggested ‘CCTV private images information protection guideline’ for private section CCTV legislation. This year Ministry of Administration and Autonomy also announced the guideline for public section CCTV guideline. It describes the installation and operation of CCTV for protecting private lives of general people, the regulation of taking images and rules on seeing, releasing, editing and deleting the images. But it doesn’t clearly describe the installation condition and management of CCTV. As it is just a guideline, it is hard to expect the efficiency of the guideline that just relies on autonomous participation of companies and institutes that operate CCTVs. The analysis of CCTV images for crime investigation focuses on the looks of a criminal, a license plate of an automobile. But it is very hard to find the identities of criminals and license plates with current installation and operation of CCTVs. It is because there aren’t enough information on the targets of analysis. Especially the resolution of CCTV, which is the absolute factor of information, is set up very lowly. So most of CCTVs are hard to achieve its goals becoming just formal installation and operation. So this research indicates the problems of CCTV operation and provides a draft for CCTV operation for crime investigation. The result of this research will be added to the CCTV regulation for crime investigation together with the related CCTV regulation that was already provided. Furthermore, it should be made as a law that has binding and enforcing power not just as a regulation.

최근 CCTV 관련 법제화를 위해 정통부와 행자부가 조사한 자료에 의하면 현재 전국에 설치된CCTV는 대략 200만대를 넘어서고 있다. CCTV는 범죄예방 및 증거확보, 시설안전 및 화재예방, 출입통제 목적으로 설치되고 있으며, 민간부분과 공공부분에서 그 적용범위를 확장해나가고 있다. 민간부분CCTV에 대한 법제화는 지난해 정보통신부에서 ‘CCTV 개인영상 정보보호 가이드라인’을 내놓았으며, 올해 행정자치부에서도 공공부분 CCTV 관련 가이드 라인을 발표했다. 그 내용을 보면 촬영된 영상물의 관리에 대한 문제, 국민의 사생활 보호를 위한 CCTV의 설치 및 운영, 촬영 범위의 규제, 영상물의 열람 및 유출, 변조, 삭제에 관한 규정 등을 정하고 있다. 그러나 CCTV의 구체적인 설치 조건 및 관리 방법에 대해서는 확실하게 규정하고 있지 않다. 게다가 이 법규는 자율적인 규범인 가이드라인이기에 CCTV를 운영하는 기업 및 기관들의 자율적인 동참에 의존할 수밖에 없어 그 실효성을 기대하기 어렵다. 범죄수사를 CCTV 영상물의 분석은 용의자의 인상착의 확인, 자동차 번호판 확인에 집중되고 있다. 그러나 현재 CCTV의 설치 및 운영 방법으로는 용의자 신원파악 및 번호판 감식은 매우 어렵다. 이는 대부분의 분석 대상에 대한 정보량이 너무 적기 때문에 발생하고 있으며, 정보량에 절대적인 요인인 CCTV 해상도의 설정이 너무 낮게 설정되어 있기 때문이다. 그러므로 현재 대부분의 CCTV는 본 목적을 충실히 이행하기 어려우며 단지 형식적인 설치 및 운영에만 그치고 있는 것이다. 따라서 본 연구에서는 현재 CCTV운영방법에 대한 문제점을 지적하고 향후 지향해야할 ‘범죄수사를 위한 CCTV 운영 방법에 대한’ 초안을 마련할 것이다. 이 연구의 결과는 이미 제시된 CCTV 관련 규범과 더불어 범죄수사를 위한 CCTV 관련 규범으로 추가 제정되어야 할 것이며, 더 나아가 규범이 아닌 구속력과 강제성을 지닌 법으로 제정해야 할 것이다.
