The purpose of this study is to provide effective ways to reduce school violence and recidivism among juvenile offenders by focusing on the significant roles of juvenile probation which is a widely used method of treatment for juvenile offenders. Most juvenile probationers are exposed to risk factors such as experience of multiple types of unmet needs, personal characteristics and circumstances associated with high risk of recidivism. These comprehensive risk factors lead to an active engagement in criminal activities. Considering the nature of these young offenders, it is necessary to implement systematic and specialized probation programs that can significantly reduce their recidivism. In the practical aspects of probation, the top priority should be the development of scientific risk assessment tools and school-based probation programs. Based on theses efforts, it is also required to reform the probation implementation system including application of the management manuals and specialization of the interview for violent young offenders in school. When it comes to the legal system, the issues concerning creation of the young offender management units, improvement of the special requirements system, and introduction of the restorative justice system are discussed.

본 연구는 소년범죄에 대한 처우방법으로 폭넓게 활용되고 있는 보호관찰을 중심으로 학교폭력을 예방하고 재범을 방지할 수 있는 효과적인 방안을 제시하는데 목적이 있다. 소년 보호관찰대상자들은 다양한 욕구결핍, 재범위험성이 높은 환경과 성향을 가지고 있 으며 이들의 복합적인 작용이 소년을 범행으로 나아가게 한다. 이러한 소년범의 특성 때 문에 그들의 재범을 줄이기 위해서는 체계적이고 전문적인 보호관찰이 요구된다. 보호 관찰 실무적 측면에서는 과학적인 분류평가도구 및 학교기반 보호관찰프로그램의 개발 이 우선 요구된다. 이를 바탕으로 학교폭력대상자 지도감독 매뉴얼 적용과 소년 보호관 찰대상자 면담 전문화 등 보호관찰 실시과정의 재설계가 필요하다고 본다. 법제도(조직)측면에서는 소년전담과 신설, 특별준수사항 운영제도 정비, 회복적 사법 의 도입 등을 제언하였다.
