Incoterms were first published by the ICC in 1936. The ICC made amendments and addition in 1953, 1967, 1980, 1990, 2000 and presently in 2010. “ Incoterms 2010 was launches in September and came into effect on January 1, 2011. The Incoterms 2010 are a Rules of international sales, and widely used in international commercial transactions. Incoterms 2010 has been regularly updated to keep pace with contemporary trade practices and the development of global trade. Incoterms 2010 accepted the changes in transport practice, the spread of customs- free zones, the use of electronic communication and security. A new classification with the new Incoterms 2010 has been introduced, that is to say, ICC has grouped two distinct classes : rules for any mode of transport and rules for sea and waterway transport. Another important change is the use of domestic and international sale contract. The purpose of this paper is to provide the revised contents and attentions for the practical application of Incoterms 2010.

Incoterms는 ICC(International Chamber of Commerce)가 1936년에 제정된 이후 거의 10년을 주기로 개정되어 왔으며, Incoterms 2010도 동시대의 무역관습을 반영하지 못한다는 비판이 대두되어 2008년부터 7차 개정작업을 수행하여 2011년 1월 1일부터 발효되었다. 이는 이국간 협정인 FTA, 다자간 협정인 WTO, 지역 간 협정을 통한 비관세지역의 확대, 전자상거래의 국제간 지속적 증대와 컨테이너화물에 대한 보안, 운송관행과 결제방식의 변화 등으로 야기되는 최근의 상거래관습의 변화를 최대한 수용하고자 함에 목적이 있다. 또한 Incoterms 2000에서 사용빈도가 적은 조건을 삭제 ․ 신규제정 하였으며, 해상화물운송조건에서 위험이전과 비용부담의 분기점인 선측난간을 삭제하고 본선적재로 개정하였고 운송방식에 따른 분류를 근본으로 하고 있다. 이에 본 연구는 Incoterms 2010의 개정배경과 특징, 주요 개정 내용을 살펴보고 실무적용상의 유의점을 도출하고자 함에 목적이 있다.
