Since the global financial crisis and recession of the european, the social unrest and disharmony between classes have increased significantly. As a result, the social conflict depending on their interests in certain policy legislation appears as a phenomenon of a legislative conflict due to the differences in age, social status and wealth. Recently, If you look at the phenomenon of our legislative, the phenomena appealing to a specific class or groups in the legislative resulted in a serious conflict in the legislative process between beneficiary and non-beneficiary by the legislative. Because of these social changes, the legislator responds very sensitively to public opinion. The lawmakers makes the legislative policy as a quick response on evaluation of their legislative works. Our qualitative, economic and cultural life depends on the achievement of the legislative goal under the constitutional value. Optimized Legislation that contains a constitutional value guarantee qualitative cultural life of national life. The development of society by good legislation enhances the national competitiveness. In this paper, I would like to seek the improvement over the legislative process.

세계금융위기와 유럽경기침체의 영향으로 인하여 향후 장기간에 걸친 회의적인 세계경기전망이 예측되고 있으며, 이러한 현상이 반영되어 미래상황에 대한 불안감과 사회경제적 격차로 인한 상대적 위화감이 그동안 큰 폭으로 증가해왔다. 이와 함께 특정정책과 관련한 입법에 있어서 빈부, 연령, 사회적 지위 등으로 분화된 자신의 이해관계에 따른 심각한 입법갈등이 우리사회의 새로운 사회문제로 나타나고 있다. 최근 우리의 입법현상을 살펴보면 정치가인 입법자들의 인기영합적 활동의 영향과 산업화의 시기동안 눌려왔던 욕구분출 그리고 다원주의사회로의 사회문화적 상황변화와 정보사회의 정치적 현실에 영향을 받으면서 특정계층이나 특정집단에 호소하는 입법현상으로 이어져 입법으로 인한 수혜자와 소외된 자의 첨예한 입법갈등이 사회문제화 되고 있는 현실 속에 있다. 이러한 사회적 변화에 수반하여 입법자는 일반국민의 사소한 여론에도 매우 민감하게 작용하고, 자신의 의정활동평가에 빠르게 작용하면서 국가의 입법정책에 관여하고 있다. 우리의 질적·경제적 문화생활도 결국은 헌법적 가치아래 최적의 입법목표의 달성에 달려있다고 해도 과언이 아니다. 이 논문에서는 어떠한 입법을 통해 헌법의 가치를 최선의 방식으로 실현하고 국민생활의 질적 문화생활을 담보할 수 있을지, 나아가 어떠한 ‘좋은 입법’을 통해 공정사회를 실현하고 지속적 발전을 유지하며 국가경쟁력을 확보할 수 있는가에 대하여 입법과정을 둘러싼 개선책을 모색해보고자 한다.
